The German is suspected of having killed the British girl, who disappeared from a vacation spot in Portugal more than 13 years ago. He is now incarcerated in Germany in connection with a drug conviction, which he served in January of next year.
The man has previously been convicted of raping a 72-year-old woman in Portugal in 2007, and it is this verdict that he has appealed to the Court of Justice of the European Communities.

The German has demanded his release as a result of the German authorities extraditing him from Italy on incorrect terms.
The 41-year-old man was extradited on the basis of a drug conviction, before being charged and later convicted of raping a 72-year-old woman.
The ruling is a defeat for the 43-year-old and a victory for German investigators, who feared they would have to release the man who is now the main suspect in the Madeleine case, although the case has not been fully investigated.

I think Madeleine is dead
German prosecutors have provided little information on what they base their suspicions on, but have determined that Madeleine is apparently dead.
The German has served several prison terms for sexual abuse of minors. He lived in the Algarve area several times between 1995 and 2007, including in a house between Lagos and Praia da Luz.
Madeleine McCann disappeared from an apartment in a Portuguese resort on the night of May 3, 2007, while her parents were at a nearby tapas restaurant with friends. So far a thorough investigation of the case has been unsuccessful and the girl has never been found.

– Do not have enough
The 41-year-old defender, Friedrich Fulscher, does not believe his client will be charged or convicted in the McCann case.
In an interview with the Australian newspaper The Sydney Morning Herald, Fulscher stated that the 41-year-old does not want to speak to investigators about the disappearance case.
– It is not unusual. It’s very normal not to talk to the police when you suspect a crime, Fulsher said.
German police admit that the investigation is difficult.
– We don’t have enough to press charges. But there are some tips that make us optimistic that the investigation will be successful, prosecutor Hans Christian Wolters tells Sky News.
