As the Consumer Council sees it, customers can demand money back for incorrectly marked face masks, but acknowledge that the problem is new to them.

Police believe that Idar Vollvik deliberately mislabelled and repackaged a mask. On Tuesday morning, the show’s businessman was arrested at his home. Shortly thereafter, the Norwegian Medicines Agency banned all marketing and sale of medical bandages from the companies Vollvik Vovi AS, Ludo Store AS and Norske Nettbutikker AS.

Vollvik denies criminal guilt.

Several clients have contacted the Consumer Council after the case became known.

– We have received some inquiries about this. As we understand it, non-medical sanitary pads are sold as medical. Consumers have a right to complain about this, says attorney Caroline Skaderud at the E24 Consumer Council.

It further explains that the client is entitled to a mask that conforms to the agreement, and if it cannot be delivered, the client is entitled to a refund.

– If after a written complaint to a store or online store, you get nowhere, you should direct the claim to the bank where you paid for the mask with a card. It’s called a card complaint, she says.

It affirms that consumers have the right to have bandages as they are marketed, and that they must be correctly marked and comply with the requirements of the legislation.

In an SMS to E24 on Saturday, Idar Vollvik writes that “any mistakes we may have made only apply to those who have received goods after August 19.”

Add that they send emails to all relevant customers.

Vollvik has not answered questions about whether customers would get their money back or if they have received inquiries about refunds.

Vollvik has previously stated that it does not believe that the sales ban imposed on Ludostore by the Norwegian Medicines Agency will result in a lasting loss for the company.

– We now have 5,000 products, and face masks are one of them, we will probably survive without selling masks, Vollvik said on Friday.

However, he noted that the company has invested “an incredible amount to get to where we are today with a bandage,” so he believes the ban on sales will be lifted.

– Vollvik himself says that it is “a lot delivered after August 19”. Can customers still request a refund for a mouthpiece purchased before this date based on the Norwegian Medicines Agency sales ban?

– The fundamental thing is the purchase for each individual consumer. If you have received non-medical sanitary pads when you should have received them, you should complain, says Skaderud in the Consumer Council.

– The consumer should take it directly to the seller and ask for documentation that he has received the correct nozzle, he says.

– Vollvik herself says that they have received incorrect documentation from another provider. So potentially the documentation presented to clients can also be incorrect. What can customers do then?

– We have not gone into that, this is a new reason for us, says Skaderud, adding:

– But if you do not receive the correct documentation, you have the right to file a complaint.

It explains that it is “simply legal”, since the consumer has the right to what is established in the contract, and that the product complies with the requirements established in the legislation at the time of purchase.

– If the product does not, there will be a defect in the product. You can request documentation from the seller that the products are for marketing and legislation.
