According to VG, the recording has given him an alibi: if this recording is to be used and if Tom Hagen is driving the car, he is not present in Sloraveien when criminal action is likely to take place against his wife.

Two minutes of conversation
On Friday afternoon, the ruling came from the Supreme Court, which declared that Tom Hagen’s detention time had ended. It is very rare that people accused of murder are released already in the first round, but for Tom Hagen they were only in custody for 11 days.
- After VG is reported, the video films Tom Hagen’s car outside of Futurum between 09.10 and 09.15 the day of the disappearance. Investigator Tommy Brøske has previously confirmed to VG that this is when Tom Hagen came to work.
- During this time, at 09:14, his wife, Anne-Elisabeth Hagen, will have a two-minute phone conversation with a family member. The conversation is described as the last sure sign of his life.

Evidence was not sustained
To the Eidsivating Court of Appeal, therefore, it should be of less value to the police to present various biological traces of the scene in Sloraveien that, according to the police, may point in the direction of Tom Hagen involved in the murder of his wife.
- VG is aware that the police have paid special attention to the discovery of his DNA somewhere in the house that they believe may link him to the disappearance.
- VG is also known to have found biological material from Tom Hagen somewhere in the home that is of interest to the police.
However, the sum of these tests was not convincing enough for the judges, who chose to release Tom Hagen.

Considered a new arrest
NRK writes that the police have considered arresting Tom Hagen again after his release on Friday afternoon, but the state attorney denied it.
– It is an important principle that the tax authority must follow the decisions of the court. And then, depending on the circumstances, I thought it was right not to arrest him immediately after his release, state attorney Kirsti Guttormsen told NRK on Saturday.

– Evidence is key to Tom Hagen, I cannot comment on them other than to demonstrate that the Eidsivating Court of Appeals was not convinced by the police argument. In my opinion, that is a very correct decision, Svein Holden tells VG.

“Due to the danger of loss of evidence, we cannot comment on possible evidence in the case,” prosecutor Haris Hrenovica told VG on Sunday night.
