Great news for Ed Oliver … the rising star of the Buffalo Bills is receiving his DWI and the gun charges were dropped due to insufficient evidence, prosecutors confirmed to TMZ Sports on Wednesday.
The 22-year-old former first-round pick, who had a rock-solid rookie season for Buffalo last year, was arrested on May 16 in Montgomery, Texas, after police said he was drunk driving.
Officers say witnesses told them they saw Oliver swerve and drive dangerously around 9 PM … and say that when they finally caught up with Ed, he was doing 80 mph by 45 and illegally passing people.
The police say that when they arrested Ed, they noticed a “moderate” smell of alcohol and said that Oliver’s eyes were bloodshot and glassy.
Officers also say Oliver had an open can of Bud Light on the driver’s side door … and claim the guy bombarded the sobriety tests.
Police also say they found a gun in his car after recording his trip.
Finally Oliver He was arrested and charged with a class B misdemeanor while driving while intoxicated and a class A misdemeanor “illegal transportation weapon.”
But, prosecutors told us Wednesday that they filed a motion to drop the charges after the drug / alcohol tests came back negative.
Oliver’s lawyer, Gary E. Patterson, made to Fox 26’s Mark Berman, saying: “The charges against Ed Oliver are being dropped by the Montgomery County District Attorney (due to) lack of evidence.”
“The blood results came back and were totally negative. He had no drugs at all in his system … So everyone knows that it is not the lawyer who is removing him. They had no evidence.”
Regarding the firearms charge, Patterson told Berman: “It is automatically dismissed because it is illegal to have a gun in your vehicle if you are intoxicated or if you are charged with another criminal act. So when the DWI is tarnished, no it’s illegal to have a gun with you. “
Oliver himself chimed in on the news, writing on his social media page, “Now go back and read this article knowing that my entire blood test was clean again !!! But I had a can of beer between my legs to get the f *** out of here, how does a 5’8 officer see inside a window above his head? Anyway, how do 5 police cars appear before taking a sobriety test huh “
Oliver is expected to play a major role in the Bills’ defense this season … He had 5 sacks and started 7 games as a rookie in Buffalo last season.
