Trump said Monday he was ready to support the deal to sell TikTok assets to Microsoft or another American company, warning that the popular video platform in the United States could be banned for reasons of national security. The president added that any sale would require that a “significant portion” of the amount be transferred to the Treasury Department.
According to critics, Trump has no authority to demand it. They point out that even if such a scheme were implemented, it would have a negative impact on business and international relations.
“You can expect this type of mafia tactic to be seen in Russia,” said James Lewis, director of technology policy at the Center for Strategic and International Studies.
“It just caught our eye then. I don’t think it’s in line with the constitution,” he added.
Bobby Chesney, a professor of law at the University of Texas who specializes in national security and constitutional law, said Trump’s proposal was “extremely inappropriate and inappropriate, not to mention that it had no legal basis.”
Former federal prosecutor Michael Bromwich wrote in a Twitter post that Trump’s claims appear to be organized crime, and mentioned the Racketeer Affected and Corrupt Organizations Act (RICO).
“It is becoming an increasingly open RICO company with each passing day,” he wrote, commenting on Trump’s comments.
Spencer Jakab and Dan Gallagher, journalists for The Wall Street Journal, write in an article that Microsoft should reject any such proposal.
“If this proposal is serious and considered legitimate, it would set a dangerous precedent for the confiscation of foreign companies through a regulated decree and open the door for American companies to suffer the same behavior,” they write.

With around a billion users worldwide, TikTok allows you to create and watch short movies on your smartphone. The platform has become TikTok’s latest target in the ongoing political and trade wars between Washington and Beijing.
The United States is of the opinion that the Chinese government can access the personal data of users collected by TikTok and use it for intelligence and other purposes. TikTok, meanwhile, denies that the Chinese government has access to your data.
