According to the representative of the court Vytautas Jončas, the case, which caused a great echo in society, began to be examined in the background. Defendant I. Papstaitienė testified in court that she understood what she was accused of, but added that she did not admit her guilt because, according to her, everything had happened by accident. The Kaunas woman agreed to give her testimony in court only after all other participants in the process had been questioned.
According to the case data, the crime was committed on the night of September 21, 2019, on a farm in the Telšiai district. According to the case file, I. Papstaitienė, being intoxicated with alcohol, knowing that the people who slept on the second floor of the building, including their relatives, young children, intentionally placed a cardboard box with glassware on the gas stove, various plastic waste, the gas taps turned off and these flammable items caught fire, intentionally causing a fire in the kitchen on the first floor of the house.
However, according to the prosecution in the case, I. Papstaitienė did not stop his criminal act for reasons beyond his control: the victims woke up, killed the fire and thus escaped.
Kaunas was also accused of damaging foreign property in a universally dangerous way, as the flame destroyed the stove, oak table, decorative brick wall, wooden ceiling, floor, and various items. During the fire, the owners of the farmhouse were damaged by more than 2,000 euros.
On the fateful day in September, a wedding feast was held for the defendant’s daughter I. Papstaitienė and her spouse on the estate.
According to witnesses to the event, the property was rented for 2 days for the family celebration.
When a drunken Kaunas woman lit a flame in the kitchen on the first floor of the house, among the guests sleeping on the second floor were the close relatives of I. Papstaitienė’s defendant: his mother, daughters, grandchildren, son-in-law, others participants of the celebration.
The General Aid Center (BPC) received two reports of an accident at the home in the early hours of September 21, callers reported a fire, said the woman who caused the fire was behaving inappropriately and threatened with burning the house with all the kids on it.
One of the witnesses, the defendant’s daughter, told officials during the pre-trial investigation that a wedding had taken place between her and her husband on the farm. According to the woman, after consuming alcohol, her mother started a conflict with her friend and children who attended the wedding. When the passions subsided, according to the witness, around 3 p.m. everyone went to sleep. In Paris, around 6 o’clock, according to the girlfriend, she smelled smoke in the room and opened the door and saw that the hallway was choking in smoke. She woke her husband, screaming and running to wake up the sleeping guests in the other rooms.
According to the witness, the women rescued small children and the men rushed to put out the burning kitchen. As he ran outside, the young man saw his mother sitting on a swing.
Firefighters, police and ambulances arrived at the scene of the accident.
During the pre-trial investigation, one of the investigators from the Telšiai Police Station, working at the scene, claimed that the defendant I. Papstaitienė was aggressive at the time and did not speak. According to the official, I. Papstaitienė did not go and was examined by the doctors, they resisted, then the police handcuffed I. Papstaitienė and soon the aggressive woman was taken from the burned house to the hospital.
During the preliminary investigation, the accused presented several versions of his case. I. Papstaitienė denied trying to kill the sleeping guests at the wedding party. She said that she had been beaten by a son-in-law on the day of the incident, which shocked her.
According to the defendant, he wanted to call a doctor for help, but could not find his mobile phone. And after starting a fire in the kitchen, he hoped the activated smoke detector would wake guests from sleep.
The defendant added that he started the fire to save himself and his health. In one of the surveys, I. Papstaitienė stated that she had not consumed alcohol at the party, only that, according to her, she had tasted hornet honey on the second day of the wedding. He had no intention of killing 11 people.
I. Papstaitienė pleaded guilty to the property in the house damaged during the fire and stated that he had compensated for the damage immediately.
The defendant’s daughter, who was in court at the wedding ceremony that day, stressed that she did not want her parents to attend her wedding because she knew that her mother, who had consumed alcohol, could behave inappropriately. However, the spouse has convinced her that the parents should attend the celebration.
The woman said that on the wedding day, the guests were festive, played various games, alcohol, according to her, was consumed in moderation, some participants of the wedding party did not consume strong drinks at all.
The defendant’s daughter pointed out that the alcoholic beverages were kept in the refrigerator and the mother said that she had consumed the alcohol.
The victim said that on the second day of the wedding, the mother began to behave aggressively, having to be restrained by the victim’s father.
The bride said the guests went to bed around 3 p.m., a couple of hours after everyone fell asleep, she smelled acrid smoke. The woman began to wake everyone up, some rescued the small children, others rushed to put out the flame.
As the victim claimed, when attacking the field, he saw a mother sitting on a swing with a smile on her face. Stuck in the memory of the daughter, the mother spoke the words at that moment: “… happy that I have no gasoline …”
The victim confirmed that she supported her claim of 5,000 euros for moral damages, the woman affirmed that she and her young children had suffered significant moral and psychological damage.
The victim’s spouse, the defendant’s son-in-law, claimed in court that I. Papstaitienė had behaved very aggressively during the incident, but the man emphasized that he had not caused any physical pain to his mother-in-law. In the present case, he and his mother, as victims, have also filed civil actions for non-pecuniary damage in court.
At the next court hearing, the court plans to question the victims further, including the owner of the house where the wedding banquet took place, and four witnesses called to court. The court plans to question a total of about 10 witnesses.
