According to the amendments presented by the members of the Socialist Group, the employer would be obliged to create a work environment in which the employees would not suffer hostile, degrading, aggressive, offensive or offensive actions. Gintautas Paluckas, the resigned leader of the Social Democratic Party, which initiated the amendments, says that mobbing is a widespread phenomenon in both the public and private sectors, and legal opportunities to defend yourself are slim.
“These amendments first identify who is harassing, so that you can prove in court that they experienced harassment. Second, the provisions of the Whistleblower Protection Law are transposed into the Labor Code, because generally a person is expelled from the workplace and does not defend their rights when they are harassed, ”G. Paluck told BNS.
“This is done in such primitive ways as not granting permits, inadequate regulation of the working day, that a person cannot combine work and family, reducing salaries without assigning certain tasks. During the period in which it was contested, it was clarified if it was mobbing or not, protection measures would be applied ”, argued G. Paluckas.
Under the amendments, the employer would be responsible in the workplace for the prevention of repetition – any and all forms of abusive, abusive or other abusive behavior directed against an individual employee.
A worker who reports psychological harassment would be protected by the notifier from the date of notification until the end of the investigation by the competent authority.
Mobbing is defined in the Labor Code as any form of abusive, abusive, or other repetitive abusive conduct directed against an individual employee or employees.
Behavior that violates the professional, material, social or psychological well-being of the employee, has an impact on the physical and mental health of the employee, his reputation and reduces the productivity of the employee would be treated as psychological harassment.
A labor dispute authority could, depending on the circumstances, recognize as non-recurring acts of a serious nature if they have violated the rights of the person.
The amendments were recorded by G. Paluckas, leader of the Social Democratic Party, who announced his resignation on Friday, Linas Jonauskas, Dovilė Šakalienė, Orinta Leiputė, Julius Sabatauskas and others.
