Administrative penalties for an administrative offense must be proportionate to the offense. They must also fulfill the legitimate and universally important objectives to be pursued, and must not restrict a person more than is necessary to achieve these objectives, ”Judge L.Šafronienė is quoted in the press release issued by the Kaunas courts.

Commenting on the decision in the case, the judge noted that by deciding not to apply the confiscation of animals, he also took into account that Ala Perederij, in response to violations of animal housing conditions and the law, had already reached conclusions in court and committed to animal housing. He also found suitable premises, rented containers for keeping dogs and bought mats for the animals.

According to the judge, based on the established circumstances and believing that A. Perederij would critically evaluate his behavior and show a proper duty to behave with care and take care of the dogs in the future, it was decided not to confiscate the animals that belonged to him.

“A. Perederij has been clarified that if the dogs are not cared properly, the State Food and Veterinary Service has the right to ask the court for the forced taking of dogs”, emphasized judge L.Šafronienė.

Shocked conditions

Images of an animal nursery found in the Jonava district last October shocked the public: the dogs were locked in narrow cages, without water, without even the necessary veterinary assistance. Although the State Food and Veterinary Service (SFVS) requested the court to confiscate the quadrupeds, the case decided to return them to the breeders.

During last year’s raid, 55 dogs from A. Perederij were taken away by veterinary specialists.

The court found that keeping the animals did not meet the law and the requirements for animal breeders. According to the court, the woman did not ensure that the animals’ freedom of movement was not restricted and that the animals did not feel uncomfortable, in pain or suffering, and carried out actions that endangered the health or life of the dogs.

Mr. Perederij, as a registered breeder, received a registration number that allowed him to keep and breed dogs in homes without using any equipment or outdoor aviaries.

The court found that the woman had dogs in the outdoor equipment and aviaries, in addition to having a much larger number of dogs than she had indicated in her 2013 description of her activities.

At the court hearing, the multiplier pleaded partially guilty. She pleaded guilty only for not providing all the documents to the SFVS, but she did not plead guilty to cruelty to animals.

The decision will be appealed

Over the weekend, Andrius Tapinas, a Facebook journalist and public figure, was outraged by the court’s decision and said that Laisvės TV, which he founded himself, would contribute to the appeal.

“Now listen – a two-legged creature, which is difficult to call a human because of such behavior, deliberately, long and selfishly tortured defenseless living beings with crocodile tears, said” I will be good “and the heart of Judge Šafronienė melted” , Tapinas wrote.

On Saturday, Tapin posted a message on Facebook outraged by the court’s decision.

“So I don’t understand why other courts were so strict when, for example, Henrik Daktar also evaluated himself in a self-critical way and promised to draw conclusions, not kill more people and install a community room in his mansion, and he succeeded in doing so. life, ”said A. Tapinas.

On Sunday, the public figure published another post asking questions about Jakov Shengaut, a veterinarian who testified on the side of the multipliers during the case. The owner of a private veterinary veterinary clinic has sided with the breeders, even though some of the confiscated animals are being treated at a clinic on his behalf.
