“In January 2021, it was written that the elevator would turn on on February 15. The elevator is not turned on now, as it is motivated that the elevator can lift building materials that could damage it.

As a result, Hanner has his own unwritten tradition of not connecting the elevator until most of the settlers are alive. Exceptions to the rules designed by Hanner apply only to families with children or people with disabilities. When I asked to start the elevator due to a change in health, I was instructed to provide photos of the installed casing. Speaking to a Hanner representative on the phone, he said that the company’s budget was being saved, so the elevators would not turn on, “said the interlocutor.

It added that the preliminary home purchase agreement did not specify any condition that the elevator be connected only after a certain time, under certain conditions.

The Delfi girl, who bought a house on the fifth floor of the apartment building, said her back is weak.

“My health has not drastically deteriorated, I have not acquired a disability, but due to the quarantine I have been working from home for a year, I cannot go to the gym, the furniture in the house is not very ergonomic and I feel back pain severe for a good half year. In the absence of normal conditions for sports and massages during the quarantine, the problem has become very acute, “he said.

The interviewee also said that during the installation of the apartment he had to meet with the teachers, the designer.

“At first, I was patiently walking up the stairs in pain, because I was waiting for February 15, the promised start of the elevator. Until then, all the building materials of the new apartment have been removed and used for a long time,” he said.

“The arrogant and domineering tone of Hanner’s representative on the phone is even angrier when I ask him what belongs to me,” added the girl.

The disputes continue

As Simona Polianičkaitė, Hanner’s office manager, informed Delfi, elevators in residential buildings are designed to lift residents to the chosen floor of the house.

“However, in Lithuania there is a practice of buying unfinished apartments, and residents who have bought an apartment are doing repair and finishing work on them for several more months.

Workers hired by the population do not use the elevators for their intended purpose, lift construction materials, very often the elevators are damaged and even broken. Residents refuse to cover elevator repair costs, nor do they assume responsibility for damages, but are required to treat them as warranty obligations.

The elevator suppliers do not agree to repair the elevators under warranty because obviously the elevators were not used to lift people but to lift construction materials. Therefore, the ongoing disputes force us to apply restrictions on the use of elevators during the repair and finishing of the apartments, ”he said.

However, according to a Hanner representative, the elevators are always on when requests are received from people with young children or people with health problems.

“In the case you mentioned, we have no data that the girl currently lives permanently in the specified house and that she has health problems.

We will verify the information and if the facts of your letter are confirmed, the elevator will be turned on. We always value our clients and take care of them all the time, ”he said.

For his part, the owner of the apartment informed Delfi that the elevator was working before receiving a response from Hanner.

“I am pleasantly surprised that you did in one day what I have been fighting for for weeks. I don’t know if it is a coincidence, but today the elevator started,” said the girl.

Natalia Jarmulkovič, representative of the State Service for the Protection of Consumer Rights, stated that according to the Civil Code, before entering into a contract with the consumer, the entrepreneur must provide the consumer in a clear and understandable way with the necessary, correct, information, complete and not misleading about the goods sold. and services provided, execution of the contract

N. Jarmulkovič added that according to the Consumer Protection Law, a consumer who believes that the service provider has violated his rights or legitimate interests must first contact the service provider in writing and state his claim.

“If the service provider does not provide a response to the consumer within 14 days from the date of receipt of the consumer’s request, or does not agree to satisfy the consumer’s claim, the consumer has the right to request an alternative from SCRPA. (out-judicial) resolution of consumer disputes.

It should be noted that the SCRPA evaluates each case individually and impartially, based on the written and material evidence provided by the parties to the dispute, ”he said.
