The public institution “Moscow Center of Culture and Business – Moscow House”, which is carrying out the construction of the “Moscow House”, asked the court to annul the decision of the municipality to reject the design proposals for the building and compel them to reconsider.
In rejecting the builders’ design proposals, the municipality relied on the conclusion provided by the Department of State Security (SSD) that the object under construction represents a threat to national security. As a result, the court involved VSD as a third party to the dispute.
“After examining the non-public case file filed with the VSD court, the panel of judges concludes that the decision to refuse to coordinate project proposals with the applicant regarding the subject of the dispute is justified and legal. The fact that the reasons for adopting such a decision have not been discussed in detail in the Decision, possibly due to the non-disclosure of the case file, does not constitute a reason to assert that the Decision itself is unfounded or illegal ” , reads in the ruling of July 21.

The decision is justified.
In Vilnius, at the intersection of Juozapavičiaus and Rinktinės streets, the construction of the Culture and Business Center started in 2010, but, according to the initiators, construction was stopped due to lengthy procedures in Moscow, and later due to the actions of Vilnius municipal administration.
Vilnius Mayor Remigijus Šimašius, based on the conclusion of the SSD, has said that this object is “a propaganda tool for the Kremlin and represents a threat to Lithuania’s national security.”
Lithuanian intelligence has mentioned the Moscow House in evaluating threats to national security since 2015. According to intelligence, the project, funded by the Moscow city government, is one of the most important Russian means of financing and coordinate compatriots living abroad, and the Russian embassy in Vilnius is actively involved in the project.

According to the VAAT panel of judges, according to the data collected in the case, there is no reason to affirm that the decision taken by the Vilnius municipality is illegal and unfounded.
“It follows that the accused (Vilnius city municipality, 15 minutes the contested decision reasonably refused to coordinate with the applicant (Moscow Center for Culture and Business – Moscow House), 15 minutes passed.) project proposals based on the information provided by the SSD “, – indicates the order.
The decision can be appealed to the Supreme Administrative Court of Lithuania within 30 days from the day of its publication, filing an appeal with the Vilnius Regional Administrative Court.
Alexander Makarov, head of the public institution “Moscow Center for Culture and Business – Moscow House” responsible for the construction of the building, Tuesday afternoon 15 minutes contact failed, his phone was turned off on Tuesday afternoon.
“The court recognized that the Municipality, after evaluating the information provided by the SSD, had reasonably refused to coordinate the project proposals of the Moscow house for the construction of this building. This means that if such a judicial decision comes into effect and remains unchanged, the Moscow house cannot be legalized and the part that exceeds the height will have to be demolished as illegal construction. However, this scenario may still change: this judicial decision is not yet final, it can be appealed and, if appealed, the final decision will be made by the Supreme Administrative Court of Lithuania “, – in the comment. 15 minutes says Povilas Poderskis, Director of the Vilnius City Municipality Administration.

The builder expects money from Moscow
15 minutes I recently visited the so-called Moscow houses in the center of Vilnius, which became a great place for homeless people and graffiti artists. Since the owner of the building has to legalize the construction for another two years, the object is poorly maintained, so almost everyone can enter. It is also used by graphic artists who have decorated the building with various inscriptions.
So A. Makarov 15 minutes He said he has no money to maintain the building, and that it is only enough, for example, to remove construction debris.
“We are waiting for financing. Here is a quite complicated process, the money is waiting for us to fix it, – said A. Makarov. – The location is really beautiful, in the center. Moscow understands this, appreciates it and tries to allocate money as soon as possible. possible “.
According to him, the Moscow municipality should provide more answers on the financing of the project in late July: “Everyone, both the embassy and Moscow, are really interested in having that house.”
The building does not meet the detailed plan.
15 minutes recalls that in 2016 the Vilnius City District Court partially satisfied the claim of the State Inspectorate for Space Planning and Construction (VTPSI) and recognized that the building permit issued in 2008 was illegal. The builder is required to re-prepare the project within three years, obtain a building permit, and reduce the building by one floor.

VTPSI told the court that according to the detailed plan prepared in 2005, it was possible to build a 6-story building in the area of A. Juuopavičiaus street, but in 2008 the Moscow House of Culture and Business Center Moscow designed and then built a 7-story building. The municipality granted him a permit in 2008, which did not verify the project solutions.
The idea of building a house in Moscow in Vilnius was born in July 2004, when the then mayor of Moscow, Yuri Luzhkov, visited the celebrations of the 750th anniversary of the coronation of King Mindaugas. Then it was decided to carry out a similar project in Moscow.
It was announced that these houses would be a center for cultural and commercial cooperation, the aim of which is to create and further develop good neighborhood relations between Moscow and Vilnius.
