It all happened on March 8, 2019, when after school the girl took off her jacket and was already preparing to go to work with her mother. Gym cleaner Ivan B., who approached him, told him to go together.

“I thought I was contributing something. When something is translated, Ivan tells the teacher to fix it or tell the teacher, ”the girl recalled, testifying before the pre-trial investigator.

Upon entering the room, the man hugged the girl and began to grab her by the buttocks with both hands. “Do you feel?” He asked.

The frightened girl finally escaped from the gym’s auxiliary rooms and rushed away.

“I don’t understand why he did that, but I felt bad,” said the girl. – The next day, when I went with my friend, he looked at me very crookedly and laughed. Now I’m very scared, I don’t want to remember that. “

The school management reacted decisively.

The victim told a friend what she had experienced. And the latter decided not to remain silent and passed it on to the parents, who informed the school management.

Upon learning of the incident, the director called the cleaner at his office and asked her to explain.

“Ivan was confused, excited, he did not seem to understand what was happening. He confirmed that he had invited the girl to the basement, to the technical staff office,” said the school principal in court.

When asked why he did it, the man was silent for a long time. To break the silence, the director started teasing him, “Maybe you wanted to give him a flower on March 8?”

“Yes, a flower,” Ivan replied with relief, and the director saw joy on his face. It was this version that later became the defendants’ main defense in court.

The questioned man admitted that he may have hugged the girl. The director decided to report everything to the police.

Guilt was denied

Soon the cleaner himself requested the resignation, but this did not save him from criminal liability.

Standing before the court, he said he saw a sad girl and wanted to give her a flower. Since it was March 8, he had acquired them. So he invited her into the room.

In court, the man claimed that the girls had not touched a finger, but trial judge Anatoly Janushevsky was not persuaded by such a speech.

“Although defendant Ivan B. denies guilt for abusing the minor victim and denies that he was easily harmed, his guilt in committing these crimes is fully proven,” the judge ruled.

This was confirmed not only by the testimony of many witnesses, but also by video recordings of how the girl went with the cleaner to the auxiliary rooms.

The court found that the man’s actions had caused the minor a serious health problem.

“The court finds that the victim’s other reactions to severe stress, corresponding to a mild health disorder, are directly causal related to Ivan B.’s illegal conduct toward the victim,” the verdict said. “Defendant Ivan B., in abusing the minor, realized that his actions could have negative consequences for the minor, and while he may not have wanted such consequences, he deliberately allowed them to occur.”

Escaped from prison

The man who committed two serious crimes avoided an actual prison sentence.

Although he denied guilt, the 61-year-old man had never had a police problem before. Not only was he not convicted, but he had no administrative sanction in his life.

“Prior to the incident, the school principal described it positively, the accused committed abusive actions once and for a very short time, approximately 30 seconds, but even those short-term illegal actions caused mental and psychological harm to the minor victim and they easily damaged his health. ” the court believes that the goals of the sentence will be achieved by imposing penalties close to the minimum, “the court assessed.

According to the court, for the man to no longer commit the crime, it is not necessary to send him to prison.

“The objectives of the sentence will be achieved without the actual execution of the sentence, therefore, the execution of the sentence is postponed for 2 years, forcing the accused Ivan B. to participate in the behavior correction program,” the court.

The man was sentenced to a cumulative sentence of one and a half years in prison. You will also have to pay 2.5 thousand to the victim. euros
