VT, a foreign businessman who lives with his wife in Lithuania, is on the bench. A man has opened a cafe in Vilnius. The businessman was charged with intentionally breaking down a stranger’s car and driving while intoxicated.
In court it turned out that more people are involved in this story. First, an employee of a cafe in the EC with whom the employer has had a close relationship for 2 years. There is also a close friend of the girl in the UK, whose car was enraged by an angry businessman.
The businessman, who returned home after his actions, confessed to his wife his close relationship with the employee. After hearing from all parties, the court took pity on the reckless businessman and acquitted him of criminal responsibility, but imposed certain penalties.
“Walled” in the fence
According to the case, the defendant VT intentionally damaged the property of other people. On September 29, 2020, around 5:30 pm, in a farm yard that belongs to his cafe, a stranger’s car crashed for personal reasons.
While driving his Jeep Grand Cherokee, entering the parking lot, the businessman especially increased speed and deliberately struck the built Audi A6 with the front of his car.
VT then drove back and reentered the rear of the car that belonged to the victim in the UK, pushing the vehicle up to the fence until the car leaned towards him. VT then left the scene.
The defendant was also found to have consumed alcohol after the accident, when he was diagnosed with 2 per thousand intoxication. Violated the obligation imposed on road users involved in an accident not to consume psychoactive substances (alcohol, drugs, psychotropics and other intoxicants) immediately after the incident until sobriety or intoxication has been controlled or rejected.
He confessed everything to his wife
In court, the businessman pleaded fully guilty to having committed the criminal charges against him. He said he was in a business meeting the day of the incident. I was sober. On the way home he headed to his farm.
Driving into the backyard, he spotted a stopped British car, the Audi A6, in its place. The UK was out in the yard at the time, smoking together with his cafe employee, EC. The businessman said he had banned the UK from parking at the site, he was warned a couple of times.
The businessman admitted that he and the cafe employee had a close relationship with the EC for several years. Angered by the girl’s dealings with the UK, the businessman shook his Audi A6 twice in the car he was driving.
Then the turned man drove home. When he returned, he told everything to his wife NT, to whom he also admitted that he had close contact with an employee of a cafe in the EC.
Annoyed, he drank a bottle of wine. Later, police officers approached him and found him intoxicated. Indemnified for damages caused to the insurance company.
The businessman’s wife, who testified in court, said she was at home on the day of the incident and that the husband had gone to work. The caller admitted that he was in love with the employee EK, so the woman got angry with the man and went to her father’s forest, he wanted to be alone, think about everything.
The woman also reported the conversation with the man to the CE itself. When she returned home, she had a husband. He came back very excited, he told me that he had damaged the car. The man had not drunk, but he had a bottle of wine with him. The woman said the man confessed to her that he had been in close contact with his employee for two years. The businessman’s wife left the house and later learned that the police were searching her.
Suspect he was already drunk
The court also heard testimony from an employee of a cafe in the EC. He said he was working in a cafe owned by said businessman on the day of the incident. She interacted with him for about two years, after which she met the UK.
The businessman allegedly prohibited him from communicating with the UK. There is a patio near the cafeteria that is not fenced, there are no signs prohibiting parking of other cars there. According to the girl, VT, who came to the backyard of the Jeep Grand Cherokee during the day, spoke somewhat vaguely, stated that he was in love with her, and broke her phone.
After that, he left. He thinks that even then VT might have been intoxicated, because he spoke incoherently, he staggered. The girl was then called by his wife NT, who explained that she had interacted with her husband and that he confessed their relationship. The cafe women even said they didn’t want to live any longer.
Scared, the EC called her friend in the UK and asked him to go to the backyard and put her out of work. He also went to the police in search of the words of the businessman’s wife. Later arriving in the UK and interacting with him in the yard, VT arrived by car, who intentionally collided with a friend’s car twice.
The victim in the UK provided the same background to the incident. He said he knew the defendant. That day he was called by his close friend EK at the time, who announced that he had quit work and asked to take her because he was away from home.
The man visited her workplace while helping her fetch her chairs and taking her home as well. The car was always parked in the yard. A Jeep Grand Cherokee VT soon arrived there, spotting his car and hitting him twice before his car leaned against the fence.
The UK had no doubt that the businessman might have damaged his car out of jealousy. The insurance paid him an insurance premium of 1,040 euros for the damage suffered to the car, but the difference in the value of the car was not compensated.
Decision of the Court
The court decided to release VT from criminal liability under the guarantee by transferring it to the liability of the unsecured spouse and establishing a guarantee period of 1 year. The criminal case was dropped.
But the businessman didn’t get away with it so easily. You have been prohibited from exercising your special right to drive road vehicles for two years. It was also decided to impose a criminal sanction: the confiscation of a Jeep Grand Cherokee in favor of the state.
It was also decided to grant civil action in the UK in part. The victim received 500 euros in moral damages from the businessman. The sentence can be appealed within 20 days from the date of publication.
