After finding a Volkswagen Passat that is not used in Lithuania on the advertising portal, the woman decided that the purchase was suitable for her. It costs 5,900 euros in 2012. The show’s automatic transmission car, as indicated in the advertisement, was brought to Lithuania from France.
The seller did not provide the body number (VIN), but the ad assured that the car was in order and that everything was working as it should. He promised to provide more information by phone. If the car already has a mandatory SDK you also did not provide information.
Nothing has changed
According to Ramūnas Mackevičius, sales manager of Autopretenzija, who received a request for help from a woman, in the past, car resellers gave the buyer a car purchase and sale agreement concluded abroad, the so-called “kaufer” , and they told you what to say when registering a vehicle. This situation has not changed now that the Owner’s Declaration Code System has come into effect.
“Those ‘shock absorbers’ have not gone anywhere. The woman was taken to the Regitra almost by the hand, registered, said that it was she who bought the car in France. And the employee of” Regitra “had no questions, because no it is their duty to verify who actually bought the car, “said R. Mackevičius, adding that not only did the car break down, the woman bought it in installments.
According to him, it is very easy to do so, because a copy of a sales contract concluded abroad, which includes both the name of the seller and the buyer and other data, remains for abroad, and in the Lithuanian part – blank, Only the seller’s data, in this case French, you can enter what you want in the blank lines. Therefore, it is very difficult to verify who actually bought the car, and the employees of Regitra, which manages the country’s transportation registry, are under no obligation to find out who actually bought the car abroad.
“Believe me, nobody checks those cars, they don’t stop on the road, and even if they do, very soon the drivers inform each other that there is control on the road and they turn on the secondary roads. In the European Union the circulation of Cars is free and there is no reason to stop everyone and check, the “kaffirer” is not declared anywhere, nobody checks it, “said the interlocutor.
According to him, even if Regitra employees, when registering a new vehicle in Lithuania, asked the future owner whether he actually bought the car abroad, it would hardly change the situation.
“A person who has already paid money to the reseller would have no choice but to say yes, he bought it himself,” R. Mackevičius made no secret of his skepticism. – The woman had also already paid the money, they had told her how to speak and in the end she trusted the reseller. After all, when people buy cars, they do it every few years, they don’t know all the niceties. “
Nobody needed the SDK
According to R. Mackevičius, managing shadow trading in Lithuania was possible and much easier than with the introduction of the SDK system. The specialist assured that it would have been enough to simply associate the bodywork number (VIN) with the telephone number of the person who sells it and the code of the person or company that sells the vehicle.
It is the phone number the woman called when purchasing a Volkswagen Passat and discussed the details of the purchase that should help find the person who sold the defective car and return the product and get the money back.
“It just came to our notice then. Linking a VIN number, a personal or business code, and a phone number would greatly simplify things. After all, all cars are sold with phone numbers, and the latter are easy to trace. these days. There would be no resellers selling low-quality cars, “said the interviewee.
Must check before buying
As Emilija Bardauskienė, Regitra spokesperson, commented on Delfi, from May 1, all vehicles sold in Lithuania must have an SDK. Therefore, according to her, before buying a car, one should make sure that such a code is assigned to it. This can be done here.
It is also advisable to indicate this code in the sales contract. In this way, the buyer will know that he is buying the vehicle from the real owner and if after the transaction it turns out, for example, that the car has certain defects, the client will be able to contact the former real owner and claim their responsibility ”, stressed E. Bardauskienė.
In addition, the specialist stressed, the buyer must find out and make sure that the contract of sale is concluded with the real owner of the vehicle.
“As far as vehicle resellers are concerned, they are subject to exactly the same rules as others. That is, before selling vehicles, they have to declare that they own them and receive an SDK,” said a Regitra representative.
However, compliance with these obligations is monitored by the control authorities. Inspections are carried out on the road, during the transport of vehicles by road, when braking individual vehicles, in markets and other car outlets, analyzing vehicle sales advertisements in the electronic space, etc. Car dealerships can be inspected by officials of the State Tax Inspectorate, the Lithuanian Customs and Financial Crime Investigation Service, the State Border Guard Service, the Police and the Lithuanian Transport Security Administration.
