SAM: Physical court hearings can only be arranged in exceptional cases where they cannot be postponed

The possibility of holding a court hearing is physically assessed on an individual basis, taking into account the circumstances of each case. Likewise, only people whose participation is necessary may attend the meetings. In addition, employee flows must be managed.

During quarantine, all judicial functions must be performed remotely. Exceptions apply when citizens must exercise procedural rights in the performance of their civic duties, such as access to the file, and their participation in judicial hearings is necessary.
The work of judges, judicial staff and visitor services shall be arranged remotely, except when the relevant functions must be performed at the workplace.

The recommendations emphasize the need to manage workforce flows. Whenever possible, different start, finish, and lunch break times should be applied to different streams of workers. It is also encouraged to ensure that different groups of people do not have contact in common areas. All workers must wear face shields.

SAM recalls that during the hearing in the physical court all participants must wear personal protective equipment that covers the nose and mouth, keep at least 2 meters away from other people, disinfect their hands in the courtroom, during the breaks announced during the hearing and after the hearings. The room should be ventilated and contact surfaces disinfected after meetings.

The Ministry of Health indicates that when a person goes to the courts or the forces of order, the restriction to leave the place of residence or go to the territory of another municipality is not applied, as it is an exit for justified reasons.
