As Eglė Samoškaitė, advisor to the Minister of Social Security and Labor Linas Kukuraitis, told BNS on Friday, currently parents can receive both incapacity for work and sickness benefit for a child in isolation only when such a scheme is advertised in an institution. educational.
Furthermore, the benefit can only be paid for children in kindergarten, pre-school and primary school.
In the absence of such a scheme, parents can only claim inability to work, which means that they have the right not to go to work while the parents take care of the child, but are not paid for it.
The regime that limits the spread of infections, according to the minister’s advisor, is the temporary cessation of face-to-face education for a class, several classes or the entire school, but it must be announced only in coordination with the municipality.
“In such cases, we want the parents to receive not only incapacity to work, but also sickness benefit during the period when the child is isolated due to the threat of the coronavirus.” (…) We will propose to the Seimas that sickness benefits be paid to all parents during the previous periods before the amendment to the law comes into force, ”he said.
It also means that those whose children have been exposed outside the school setting will also be able to receive sickness benefit, as is the case now.
He also emphasized that the current regime by which the National Center for Public Health can provide parents the opportunity to receive incapacity to work for a child under 14 years of age in self-isolation is against the law. Whether or not there is a special regime in school, parental disability should be granted only to children in early childhood and primary education.
“The current order is being changed because the 14-year-old law only refers to sick children when they are cared for by working parents, guardians or grandparents. Meanwhile, for self-isolation or in other cases, there are no 14 years, it is the end of primary education, the fourth is the oldest person for whom parents must receive work disability, sickness benefit, “explained the counselor to the minister.
According to her, there is currently a situation in which a statute is contrary to the law.
“There is a mistake,” commented E. Samoškaitė.
Among other things, the Minister’s Counselor recalled that only the NVSC can grant isolation to a child, otherwise the parents will not receive the benefit for incapacity for work or illness.
