More than a year ago, the Panevėžys Regional Court found the man guilty of only one minor episode of poor health in his loved one, at which point he was sentenced to 10 months in prison.

This decision was appealed both by the prosecutor Valdemara Chodorcevičienė, who had supported the state prosecution in the case, who had requested a stricter punishment and retraining of criminal offenses, and by the convicted person, who requested full acquittal.

After examining the case, the Court of Appeal dismissed the man’s complaint as unfounded and the prosecution confirmed the complaint in part and found the convicted person guilty of two minor episodes of ill health and indirect intentional suicide.

According to the court, the data in the case suggest that the systematic use of physical and mental violence against the victim can be considered cruel treatment to the victim, which led to suicide.

According to the court, by systematically raping the girl, the prisoner realized the danger of his actions and ordered that the victim could commit suicide as a result of his actions. The violence against him for two days in a row, although he did not seek such consequences (…) deliberately allowed those consequences to occur, ”said the Prosecutor’s Office in a statement.

The pre-trial investigation in this case began after the body of a 22-year-old girl was found near an apartment building in Panevėžys in September 2018. It was soon discovered that she was living on the fourth floor of this house.

The policemen summoned to the scene were suspicious of the behavior of the deceased girl’s partner. The drunk man had his face scratched and he kept telling in a different way how hurt he was. In the couple’s rented apartment, officials found signs similar to the fight, blood stains. Later, the experts discovered that it was the blood of the dead, ”writes the prosecution.

The investigation revealed that the partner had beaten the girl on more than one occasion, she recounted the violence that she had experienced on the eve of the disaster in the hospital where she was due to bruises.

“The next day, a few hours before the tragedy, the girl asked for help writing SMS messages to her friend, the owner of the apartment and other people,” the prosecution said.

According to her, the girl’s friends also saw injuries on her body and suspected that her partner was abusive, but the girl allegedly inadvertently hurt herself.

The pre-trial investigation in this case was conducted by officers from the Criminal Police Serious Crimes Investigation Board of the Panevėžys County Police Chief Commissariat.

The decision of the Court of Appeal takes effect immediately, but can be appealed to the Supreme Court of Lithuania.
