Opposition members Seimas appealed to the Constitutional Court about the use of the PSDF reserve

“The current legal regulation creates preconditions for the Minister of Health to use the funds at his own discretion, at any time. There is no need for any objective reason, such as a global pandemic, an emergency situation or announced quarantine throughout Lithuania.” I. Šimonytė told the media.

According to her, the current procedure creates a situation that not only conflicts with the Health Insurance Law, but also with the principle of separation of powers established in the Constitution, when the Minister of Health exercises the powers assigned to the Seimas.

Therefore, together with a group of Seimas members, we appeal to the Constitutional Court to investigate whether the current legal regulation, when the Minister of Health can use PSDF budget reserve risk management funds to reimburse the same expenses principle “said I. Šimonytė.

The appeal states that the expenses provided for in the PSDF budget are approved by law, along with the budget for the year in question. However, reserve funds may be distributed by the Government or the Minister of Health in special circumstances. In accordance with current legal regulations, the Minister of Health has the right to use the funds from the PSDF budget reserve for the same expenses, the amounts of which are approved by the Seimas in each calendar year.

Furthermore, it is pointed out that the current legal regulation allows the PSDF budget reserve to be used not for objective and special circumstances, but for expenses, the annual planned amounts of which must be approved by the Seimas when the respective year’s budget is adopted.
