For this, the court sentenced him to 2 years and 7 months in prison. It turned out that Eugene K. had already been sentenced to 10 years in prison for another crime.

So, summarizing these two sentences, the husband was sentenced to a final sentence of 11 years and 6 months in prison. The conflict that prolonged his incarceration arose when Eugene K. was asked to leave the apartment while drinking.

Slipped on a flat surface

According to the case, Eugenijus K. found himself on the bench as a result of physical violence, when human health was easily disturbed. The violence was found to stem from hooligan incentives.

The conflict dates back to 2019. June 13, at approximately 2 pm, in an apartment owned by VB. Due to the inferior reason, that is, during drinking, when the owner of the apartment urged Eugenijus K. to leave the house, he violently parted.

The man hit VB in the face and body at least five times with his fist. The victim fell to the ground.

Therefore, bruises on the face, bruised wounds in the area of the right incense, reciprocal fracture of the lower jaw, complicated fractures of the ribs easily damaged VB’s health.

The court, when assessing the data collected, concluded that the evidence collected and examined in the case unequivocally confirmed the fact that it was Eugene K. who committed the violence, although there was no basis for the violent acts.

The perpetrator’s actions had no clear motivation or excuse, influenced by the alcohol consumed that night. The district court found that the defendant was violent against a respectable and completely unknown person in his own home.

Blamed someone else

Eugenijus K., who did not agree with the court ruling, appealed. He requested the annulment of the sentence handed down and his total acquittal. The man stressed that he was illegally and unreasonably convicted.

In his appeal, the man repeated the testimony of a woman who had testified in court that she had confessed to acts of violence against VB, but had been rejected by the court because the woman had a serious mental disorder.

The woman in question lived with VB Tad Eugenijus K. tried to take advantage of them. The man said the couple were constantly posing emotional scenes, allegedly hurting each other, calling the police in blood.

The convict emphasized that the DP himself had psychological problems, so the court unreasonably relied on the testimonies of these people (victim and witness – aut. Past.).

The perpetrator was outraged that the victim’s neighbors had not been questioned during the investigation about the circumstances of the crime and no officer had been questioned in the case.

Eugenijus K. emphasized that the witness called a lawyer and admitted to having committed physical violence against VB

The man also did not agree with the generalization of the punishments. According to him, the court added an excessive part of the sentence by imposing an overly strict final sentence of 11 years and 6 months in prison.

Eugenijus K. requested the court’s favor by stating that he has health problems, heart disease, that he is unable to work due to a leg injury in the past, and that he will soon have to undergo leg surgery as well.

However, such arguments of the abuser did not convince the Vilnius Regional Court. Therefore, he was found guilty. Eugene K. will have to serve his sentence in a correctional facility.
