“State lands are owned by all of us, therefore the entered into state land lease must provide public benefits. If the tenant does not use the parcel according to the intended purpose without objective reasons, the contract must be terminated immediately and transferred to the person who will create added value ”, says G. National Land Service (NSS) 2019 inspected 30,165 leases and decided to terminate 830 contracts (including 117 leases). Of the 830 lease / loan contracts that were decided to terminate, state control of land use was carried out on 206 plots, during which violations were detected on 165 plots.
The most common reasons for terminating contracts are that some (or all) of the buildings are in ruins, the land is not used for its intended purpose (for example, agricultural land is not used for agricultural activities), or the rent is free during a long time, the lease expires, the people who rent the plot buy it, give up the land of the personal farm that is given to them, the tenant dies, etc.
2019 13,094 land use inspections were carried out at the site, of which 3,976 cases of violations of the land use procedure were identified.
According to Alina Šileikienė, Chief Specialist at the Ministry of Agriculture, from now on, NJT officials will be able to conduct an unscheduled inspection of the land use of an adjacent parcel or other parcel of land when inspecting the land use of the installation and detect potential land use violations. Before beginning an unscheduled land use inspection, the NNT territorial division shall provide the owner, user or manager of the inspected object with a copy of the decision to conduct an unscheduled land use inspection.
To ensure that in all cases, action is taken immediately upon receipt of citizen complaints about potential land use violations, the NJT will have to conduct an unscheduled inspection of land use within 15 business days upon receipt of information about the possible violation, as well as in writing or by email. inform people who have notified of possible infractions within the periods established in article 31 of the Law on the decision taken to carry out (not carry out) unscheduled land use inspections.
Furthermore, the provisions on state control of land use clarify the concept of non-management of agricultural land to be considered fit for purpose: if agricultural land is covered with trees, shrubs or other woody perennial plants, it is considered abandoned. and not managed. to be fit for its intended use.
The Ministry of Agriculture also encourages municipalities to cooperate more actively with the NJT, to report possible land use violations, and to pay free land rent in a timely manner.
This year, a total of 13,980 state lands are planned to be inspected for other purposes and 14,958 lease / loan agreements for agricultural, forestry, water management and conservation lands.
