“I have been watching pornography for two years at home using an Acer laptop,” Sergei L. told police. “It was my secret, nobody knew I was watching pornography.”

The man said that he mainly looked at images of adult pornography, but “I also looked at children”: “Because there was both child and adult pornography on the pages I visited.”

Sergei L. argued that he viewed pornography just out of curiosity.

“I never downloaded pornography on my computer or anywhere else, did not show it to anyone or distribute it,” said the defendant Vilnius resident. “I don’t care about child pornography, but I could see it on the web.”

At the time, police officers said Sergei L. had been viewing pornography from February to September 2020, when his home was searched and a computer was taken from him. An inspection revealed that 1,425 porn sites were visited during this period.

“The computer also used the social network Twitter to view suspected pornography microblogs, as well as pornographic chat platforms online,” the researchers said.

Sergei L., a specialist who inspected the computer, claimed that the man, who was responsible for the videos and photos, did not send them to his computer.

“They were seen simply because each web browser saves video documents, clippings, snippets, or other data in a cache on a computer,” he said. – Video documents remain on the computer regardless of human actions; These video documents, snippets, clippings and other data can be deleted by one person – transferred, saved to media or other directories created on a computer. According to the Court, the Directive of the European Parliament and of the Council on the fight against sexual abuse, sexual exploitation of children and child pornography establishes that, to be prosecuted for knowingly obtaining access to child pornography through the technologies of information and communication, you should intend to visit a website that contains child pornography material and be aware that such images can be found there.

“Penalties should not be imposed on persons who inadvertently access websites containing child pornography; the intentionality of the infringement may be determined, in particular, by its recurrence or by the fact that the infringement was committed with the use of a paid service ”, the Court stated that each country in the European Union must take the necessary legislative or other measures to ensure that intentional acts committed without a right are punishable, such as the deliberate acquisition of access to child pornography through use of information and communication technologies.

“ The court assessed the frequency of visits (February to September 2020) to websites visited by Sergei L. that contain pornographic objects depicting a child or a person as a child, as well as pornographic objects depicting a child. or a person (39 pornographic video documents), there is no basis to conclude that Sergei L. accidentally accessed these documents online: on the contrary, Sergei L.’s repeated actions, carried out over a sufficiently long period of time , indicate a prior intention to access pornographic material on the Internet that contains depicts minors. ”, – Judge Ražanskas stated that there is no doubt that Sergei L. deliberately reviewed pornographic image documents depicting a child or depicting a person as a child.

“While keeping records of child pornography is an easier crime than distribution, the very fact that a person is interested in such things is already a serious sign: it is necessary to be interested in what we do,” authorities said.

According to them, child pornography “fans” who get caught up in Lithuanian officials often offer various excuses, but the real truth about why they downloaded, kept or even distributed pornography is not dared to say out loud.
