A new ban is gaining ground in the Seimas: there would be even fewer places where smoking is possible

According to the bill drawn up by the Seimas Health Affairs Committee, it is proposed to toughen the smoking rules. It is proposed to ban smoking in co-owned homes, whether or not there are non-smokers who object.

There are also additional smoking bans at covered public transport stops (pavilions), playgrounds, and places where catering services are provided to serve customers outdoors (at outdoor tables, gazebos, other outdoor facilities), except in smoking areas.

Aušrinė Armonaitė, the chairwoman of the Freedom Party, who is a member of the committee, has expressed the position that such a ban would be excessive and offered to abandon it.

“We believe that such a prohibition is excessive, because nowadays, catering establishments and themselves often offer places for smokers and non-smokers. It should also be emphasized that this ban will have absolutely no effect on reducing secondhand smoke, as despite the separate tables of the cafe for non-smokers and smokers, all will be served in the same conditions outdoors and smoke it will certainly reach non-smokers. For these reasons, we propose to abandon the Law that establishes excessive prohibitions for outdoor cafes ”, says A. Armonaitė in the proposal presented by the committee, which was not approved by the committee.

One of the promoters of the bill, the green farmer Tom Tomilini, is convinced that the bill will receive public support.

“Polls show categorical support for the Latvian regime. In Lithuania, we offer much more liberal regulation. We have gone through a very long road of coordination, consultation for almost three years. The algorithm does not prohibit, but gives the non-smoker the power to defend their constitutional right to health at home. Smokers are left with a right and a freedom that is only limited by ignoring the rights of others. The balance of interests will be ensured not by the police, nor by fines, but through a process of information, labeling and very well thought out self-government. No one will be able to punish anything until all the residents present themselves, “said T. Tomilinas.

It would not be possible to smoke on the balcony if at least one resident objects

The bill proposes a ban on smoking during outdoor sports competitions or other outdoor events, except in smoking areas, as well as on balconies, terraces and loggias of apartment buildings, when at least one resident of the house is opposed to smoking.

It is proposed that the smoker is obliged to ensure that tobacco smoke does not enter the premises of the building (apartment) of another owner and the premises of the same apartment.

If the law were passed, at the request of an official with the right to conduct an administrative investigation for a misdemeanor, a person would have to provide the official with the details (name and residence address) of the person who smoked on the balcony, terrace, loggia of the apartment or room.

The law would take effect next year.
