Police officers, who had carefully compiled data on the circumstances of the incident, found that the partner had beaten the girl several times and she was afraid of him. Her friends, upon seeing the wounds on the girl’s body, suspected that the partner was violent, but she denied it to them, accidentally explaining herself injured. The girl told about the violence on the eve of the disaster due to bruises in the hospital. The next day, a few hours before the tragedy, the girl asked for help writing SMS messages to her friend, the owner of the apartment, and others.

After examining the case, in December 2019, the Panevėžys Regional Court found TK guilty of a single minor episode of poor health in his loved one. He was sentenced to 10 months in prison.

Disagreeing with this court verdict, the prosecutor V. Chodorcevičienė, who supported the state prosecution in the case, appealed to the Lithuanian Court of Appeal. The convicted person also filed a complaint requesting full acquittal.

On appeal, the prosecutor requested the conviction of TK for another episode of violence, as well as for the systematic use of physical and psychological violence against the victim and his intentional suicide.

After examining the case, the Lithuanian Court of Appeal last week rejected the convicted TK’s complaint as unfounded and confirmed the prosecutor’s complaint in part: TK pleaded guilty to two minor episodes of ill health and indirect suicide.

According to the higher court, the data in the case suggest that the systematic use of physical and mental violence against the victim constitutes cruel treatment towards the victim, leading to suicide.

According to the court, by systematically raping the girl, the convict knew the dangers of her actions and ruled that the victim could commit suicide as a result of her actions. By using violence against her for two days in a row, without seeking such consequences (suicide), the TK deliberately allowed those consequences to occur.

As stated in the judgment of the Lithuanian Court of Appeal, the finding of the lower court that the girl committed suicide by her own choice and that the actions of the TC could not influence her choice is unfounded, contradicts the evidence in the case.

After summarizing the sentences imposed, the Lithuanian Court of Appeal imposed a final sentence of 2 years and 3 months in prison on the TC.
