The cars were parked at the entrance to the Vilnius City Clinical Hospital. After getting out of the car, Julius S. approached another car, where the NN, recognized as the victim in this case, was sitting.

Through the open window of the driver’s side door, Julius S. once intentionally slapped the man with a fist to the face. The victim had a chapped lip, causing physical pain and minor health problems.

After evaluating the evidence gathered, the court found Julius S. guilty and sentenced him to 8 months in prison. He is obliged to compensate for material damage caused by the crime during his sentence and to work 40 hours free of charge in social care and assistance institutions or non-governmental organizations that serve the disabled, the elderly or other needy persons.

Guilt was not admitted

The defendant Julius S. did not admit his guilt, explained that the conflict was, but does not recall such events, actions. After all, a long time passed between the incident and the court hearing. Therefore, the man said that he did not remember hitting the victim.

But, as he himself said in court, he may have struck. It is said that “the victim offered him such pleasure where not even his wife says.” When asked to repeat what he had heard, Julius S. refused to do so.

He was not offended by the victim’s trip but by other things. The victim wouldn’t even remember it because it was dark. The incident was that the victim showed him his middle finger, yelling unpleasantly. According to Julius S., if that man had been hit, he would have smashed his face when he stopped boxing for 12 years.

In court, the man agreed that it was wrong to get out of the car. And it all took maybe just 3-5 seconds. Defendant Julius S. joked in court that perhaps the victim needed a belt because of his shorter stature.

The defendant later said that he could have reacted too harshly. This time the victim was wearing a peaked hat. The abuser said he reached out and struck the peak of his hat. Therefore, according to him, the injuries identified by such actions could not have occurred.

The defendant has been boxing for many years, has repeatedly participated in fights and, according to him, could not have suffered such an injury in the manner specified by the victim. “Maybe he bit his lip …” Julius S. thought.

Victim version

Interviewed as a victim, NN said at the court hearing that he was driving to his rented apartment that night. There is a crossroads at the scene of the incident. The culprit drove from the side road and did not stop, he blocked the road. The victim then beeped and circled the defendant’s car.

Then the defendant made a beep, waved his hands and showed him the middle finger. The defendant then stopped the victim and was arrested. Without thinking of anything bad, NN opened the window. The defendant approached and slapped his face with his fist, and the blood began to flow.

The phone was dead at the time, so he called the police when he returned to the apartment. The victim recalled that the man who had arrived told her “what are you smoking here, maybe you bought the rights.” The conflict situation, according to the victim, started even earlier.

As a result of the accident, the plaintiff was forced to stop his car and not see the defendant. As this car passed, the applicant sounded an audible signal to get the driver’s attention as he violated traffic rules. After this car passed, their cars flattened and at that moment the taxi driver, who was holding something with his left hand to his ear (he thinks it was a phone but he couldn’t say it because he hadn’t seen it) turned to the applicant and started to nod with your hands.

Because he was wrong, the plaintiff showed his middle finger with his right hand, expressing his emotions about his behavior and the situation it had caused. This gesture meant sending and is indecent. Upon seeing him, the driver bypassed the applicant in his car, stopped him, and got out of the car. He approached the applicant’s car.

Approaching the car, the applicant rolled down the window of the left front door and stayed in the car himself and did not get out of it. Then he was hit. That’s it, the man turned and headed for his car, got in and drove away.
