Adas Liūtas de Marijampolė December 4, 2018 in a garage where they were staying with a roommate, being intoxicated with alcohol during an oral conflict, they intentionally beat a family member.
The man hit the roommate with a blow to the head, causing the victim to have a nape, a skull fracture. This resulted in bloodshed in the brain. Therefore, the woman’s health was seriously affected.
A. Leo only partially pleaded guilty. He confessed to hitting his partner on a stool. However, the man disagreed with the stated consequences: serious bodily injury.
The defendant said that the conflict between him and the victim was due to her calling him an uncensored word, so he got angry and took the chair next to him and hit the chair on the victim once from the top of the head.
The blow, he said, was not strong because the victim had just sat down and possibly lost consciousness. Then he noticed a bruise on the victim’s head. Before the conflict, he and the victim had drunk a liter of strong beer (7.5 degrees alcohol), but they did not feel very drunk.
Alcohol, according to A. Leo, did not affect violence, he would have done the same if he had been sober. The day before the victim’s injury and later until the victim’s death, he drank alcoholic beverages every day.
Three days later, he noticed traces of blood on the victim’s forehead, incisors. The latter explained that he had fallen down the hill. A day later, the woman’s health deteriorated and she died. A. Leo lived with his partner for about two years, sharing food.
The man said they drank alcohol together every day. The lion said they continued to drink strong beer after the stool hit. Later, two days later, the victim shook his head in the garage when, at night, drunk, crawling with four, lost his balance and shook his head on the shelf.
He was aggressive
Two orphan daughters also testified in court in this case. One of them said that he communicated with his mother, knew each other and called each other more often. She went to her mother during the day when her partner was at work because the latter was aggressive.
After talking to her mother, she did not hang up and overheard her mother talking to her partner. She heard her mother say to her roommate, “I’ll take you out of here,” and the roommate said, “Shut up because someday I’ll kill you.” This phrase was supposedly repeated by the man several times.
His mother has told him repeatedly that his partner is abusing her, she used to say that “I take him from here (from the garage), that he carries alcohol and he drinks it.” A. Leo, according to the woman’s daughter, had previously injured her mother’s leg, pushed her with ice, and closed her eyes in the summer.
The same was confirmed by another daughter. According to her, A. Leo constantly beat his mother and saw bruises under his eyes. He saw himself at least three times while beating his mother. He was with her once in an apartment while she was still living together.
According to the witness, when A. Leo drank alcohol, he became very aggressive, he did not orient himself in the environment, he did not recognize people. This violence against the mother continued during the five years of their cohabitation. Recently, her mother asked her to take her to live with her, she wanted to run away from A. Leo.
The sentence relieved
As already mentioned, the court found A. Lion guilty of a serious disturbance of coexistence. Initially, it was decided to sentence him to 5 years and 6 months in prison in a penitentiary.
But the appeals court reversed that decision. For the same charge, the man was sentenced to almost half a sentence: 3 years in prison.
The sentence includes a prison term of 1 year and 5 months, so after 1.5 years A. Leo must be released.
