They propose the introduction of a “first appointment” rule, that is, if for the first time or after a 12-month period only a reimbursable drug with a generic name (regardless of its strength and pharmaceutical form) is prescribed in an electronic prescription marked “First Appointment”, the pharmacy sells (dispenses) the reimbursable medication to the patient. Preparation with the lowest patient premium.

However, if a patient refuses to purchase a reimbursable medicine with the lower patient premium, another reimbursable medicine with a generic name, strength and pharmaceutical form can be sold (dispensed) at the patient’s premium, that is, reimbursing the basic premium patient. price of the selected drug.

According to A. Matul, establishing the possibility for a patient to choose not only the cheapest drug, but also another drug included in the Reimbursable Medications price list and receive reimbursement for their purchase costs, will guarantee an unreasonably restricted right of the patient choose treatment and exercise health insurance rights, and the pharmacist and doctor have the obligation to select the most appropriate and effective treatment for the patient.

According to the president of the Health Affairs Committee of the Seimas, constitutional freedom of economic activity and the rights of patients will also be guaranteed, public opposition will be avoided, since by refusing to buy a drug with the lowest patient premium the price of the drug and only the premium due for the drug.

The amendments to the Pharmacy Law aim to implement the 2019 Supreme Administrative Court of Lithuania (SACL). October 23 decision.

The SACL decision indicated that the Minister of Health exceeded its competence by establishing that the insured or his representative must be issued (sold) the cheapest reimbursable medicine according to the electronic prescription marked as “First appointment”, and If the representative insured refuses to buy the cheapest reimbursable medicine, he is not reimbursed at all for the purchase of another reimbursable medicine.

The current Pharmaceutical Law establishes that only the cheapest reimbursable medicine can be dispensed (sold) according to the electronic prescription marked “First appointment”, unless the patient refuses to buy the cheapest reimbursable medicine and purchases another medicine in accordance with the settled down. process.

Currently, the pharmacist must provide the patient with the cheapest reimbursable medicine, taking into account the generic name, strength and dosage form of the medicine as indicated on the electronic prescription marked “First Appointment”. If a patient refuses to buy the medicine with the lowest premium, any other medicine with a generic name, strength and pharmaceutical form specified in the electronic prescription can be sold to him without reimbursement in accordance with the Health Insurance Law (i.e. , purchased as a non-refundable drug).
