The court once again rejected Žukauskas’s appeal for dismissal

The Vilnius Regional Administrative Court (VAAT) made that decision last autumn, but Mr Žukauskas appealed against it.

The SACL ruled that the court of first instance had duly assessed the circumstances by which Mr. Žukauskas was deprived of the right to work with confidential information.

“It follows from the judgment of the court of first instance that the court examined this evidence in detail, evaluated the circumstances relevant to the case, denied part of the acts alleged against the plaintiff (…) and determined that the other party be justified” , the court ruled.

It follows that the applicant’s conduct contrary to the interests of the internal service, in the interests of others, influencing other officials, having or having contacts with representatives of the criminal world, avoiding a polygraphic investigation, are (…) circumstances qualifying statements that confirm the conclusion of the court of first instance that the actions of the applicant have endangered the security of the classified information entrusted to the applicant, and at the same time refutes the contrary arguments of the applicant’s appeal in this regard, “said the court . .

The judges who heard the complaint also emphasized that the General Commissioner had no option to dismiss or not an official who had lost his right to work with classified information.

Although Mr. Žukauskas stated in the complaint that the Police Department should have offered him another position, there were no such positions in police institutions where one should not have a work permit or access to confidential information.

D. Žukauskas later wrote on Facebook that he was hurt by that decision and thanked everyone who supported him.

“Today I am convinced once again of what justice is and how decisions are made, it is a pity, but a reality. I know the heroes put a lot of effort into creating this piece, it hurts, but you have to get over your nausea and fight harder. How can it not be funny and strange for me, I believe in justice and I believe that we live in a state governed by the rule of law, where laws and decisions are made by judges, “he said.

The former Kaunas police chief was fired on February 26 last year because he lost the right to work with confidential information.

The Police Department stated that during the inspection it was established that D. Žukauskas’s personal qualities, behavior and relationships with certain persons raise reasonable doubts about their trustworthiness.

Last November, the VAAT also rejected another complaint by Mr. Žukauskas, in which he requested that the conclusion of the Immunity Board of the Police Department and the order of the General Commissioner that he had degraded the official’s name be annulled.

Mr. Žukauskas did not appeal the decision on this complaint.

The Lietuvos Rytas newspaper announced that in July 2019, Giedrius Skladas and D. Žukauskas, the then head of the Criminal Police Organized Crime Investigation Board of the Kaunas County Police Chief’s Station, who had been on leave by paternity, they arrived with a Lithuanian lawyer at Villa Raimondas Karpavičius in Tenerife, Spain. And it demanded that the people who rested in the house move in two hours.

According to the publication, at that time there was already a fight for the legacy of a sick businessman. The newcomers were called to the police.

The decision of the Supreme Administrative Court is not subject to appeal.
