Seimas President Viktorija Čmilytė-Nielsen says procedures for appointing three new Constitutional Court (CC) judges were postponed on Tuesday to protect the health of Seimas members by shortening the length of Seimas plenary sessions in alive.
V. Čmilytė-Nielsen said that next week the Seimas plans to sit remotely, and according to the Statute of the Seimas, a secret vote must be held on the appointment of CC judges, which can only take place live. Therefore, according to the president of the Seimas, the appointments of the judges of the CC do not rise to the spring session.
“Our goal is for the Thursday morning session to be the last live session, to end the live session on Thursday until noon (…) If we want to finish the whole process against the CC judges, we should have a Live election not only on Thursday afternoon but also next Tuesday. ” said the president of the Seimas at the meeting of elders.
ELTA recalls that President Gitanas Nausėda nominates the judge of the CC for the candidacy of lawyer G. Lastauskienė, which has already been rejected by the Seimas, and the President of the Supreme Court (SCL) appoints Judge A. Norkūnas for this position.
The president of the Seimas V. Čmilytė-Nielsen proposes to appoint A. Kabišaitis, Head of the Legal Department of the Chancellery of the Seimas, judge of the Constitutional Court. The former president of the Seimas Viktoras Pranckietis intended to nominate A. Kabišaitis to the Seimas, who had already completed his work.
The Constitutional Court is made up of nine judges appointed for nine years and for one term only. The Constitutional Court is renewed every three years for one third. The candidates are nominated by the president, the president of the Seimas, and the president of the Supreme Court.
In the spring, the Seimas rejected the three nominees for the CC judges. The terms of the President of the Constitutional Court Dainius Žalimas, Judge Gediminas Mesonis and Judge Vytas Milius ended on March 19, 2020.
