According to the professor, even if the Seimas considered introducing a state of emergency, it would not mean that all possible restrictions and prohibitions for such a regime would automatically take effect.

“The law establishes the restrictions that may exist: there may be restrictions related to freedom of assembly, the inviolability of housing, freedom of movement, etc. Any specific restriction in a specific state of emergency (…) is provided for a law adopted by the Seimas on a state of emergency. It takes into account the necessary restrictions. It is certainly not that the whole world will be closed, locked up, the government will not work. There may be direct control, but it may not be, according to the situation. I’m not afraid of it, “the professor said on Knowledge Radio on Monday. V. Nekrošius.

According to him, a state of emergency in the country can only be imposed when the constitutional order of the state is threatened or the friction of society.

“If there is a real danger that one of the parts of the constitutional framework will collapse and the health system will be one of the parts, then it may seem possible (…) to consider the need to introduce a state of emergency. On the other hand, all the possibilities offered by the Communicable Diseases Law, which provides for a series of restrictions on movement, etc., have not yet been fully exploited. There is still a reserve there, ”emphasized the VU law professor.

Delphi After an interview with Justice Minister Evelina Dobrovolska, after listing what restrictions the Seimas could theoretically consider when introducing a state of emergency, V. Nekrošius emphasized once again that specific measures would be taken taking into account the situation.

“Control of correspondence is only possible if the Seimas confirms that it is possible to do so in this situation. The introduction of a state of emergency in itself does not allow control of correspondence, nor entry to the house, nor restriction of movement – no. The advantage here is that this restriction must very clearly list the measures that are applied during this period. They can only be those provided by law (…) and that is a guarantee of human rights, that there will be no arbitrariness ” explained the professor.

“Still. At least I personally see no reason to introduce a state of emergency,” added V. Nekrošius.
