The court representative, Milda Bučnyt B, informed BNS that the execution of the sentence had been postponed for a period of one year, and the convict was obliged to raise and care for his minor children, take care of their health and support them throughout that period.
Additionally, within six months of her conviction, she was assigned to participate in a behavior correction program.
“The court partially upheld the prosecutor’s appeal … and found her guilty of abusing her rights as a mother, systematically crushing her young son physically and mentally,” said Ms Bučnytė.
According to her, E. Geležiūnienė was also found guilty of a serious health disorder, which is related to the psychological violence used against the child and its consequences.
The court also granted the request of the victims’ lawyer and granted 1,000. for moral damage.
In January, the Kaunas District Court acquitted E. Geležiūnienė of violence against a child because it did not consider that an act with indications of crime or misconduct had been committed. This decision was appealed by the prosecution.
A pre-trial investigation into violence against a minor was launched in October 2018 after receiving a report of a child beaten from kindergarten.
With regard to this episode, the Kaunas Regional Court ruled that while the criminal act was committed, it is not proven in the case that it was committed by E. Geležiūnienė.
The woman herself categorically denied her guilt throughout the process.
During the pre-trial investigation, the boy was separated from the family for about a year, half of which he was unable to see with relatives. E. Geležiūnienė was also forbidden to see it.
A pre-trial investigation into intimate partner violence was also conducted, but was later suspended.
The decision of the Kaunas Regional Court takes effect immediately, but can be appealed on cassation to the Supreme Court of Lithuania.
