Mindaugas Sinkevičius, president of the Lithuanian Municipal Association (LSA), emphasizes that the problem of smoking on the balconies of apartment buildings should be addressed in other ways.
“Double evaluation. On the one hand, we understand the urgency that there are people for whom smoking is a big problem, a neighbor constantly smokes and the children at home are small. But if we look at it from the position of the Housing Chamber, we have not received such complaints or phone calls. But I understand that that problem can be, even if we do not call to inform us.
On the other hand, excessive regulation is now provided, the law will be based on paper. I don’t see any mechanism to really control it. Creating a law that has no practical applicability is a discriminatory legal system, ”D. Matonienė told Eltai.
“Self-government, the community must be more connected and real communication mechanisms or tools must be sought. It is possible to solve the problem in another way, “he added.
According to her, the current law would encourage the practice of complaints between neighbors.
“Each house always has different neighbors. The practice that the law is trying to do is, I would say, a bit harmful. Complaints, punishments, intimidation are encouraged. Communication must come first. We want people to be sociable, to support each other, ”said D. Matonienė.
LSA President M. Sinkevičius believes that one person should not decide how all apartment buildings should behave.
“It just came to our attention then. Clearly, those who own real estate and live in an apartment building have a case-by-case problem with neighbors who smoke, but the principle that a person in an apartment building can drive and mold the practice is that a single complaint can shape the practice how all apartment buildings should behave. The majority principle is generally followed, “said M. Sinkevičius.
“A person, a person may not necessarily act objectively. “… It does not seem, to put it mildly, a solution based on logic,” he added.
M. Sinkevičius admitted that there is the problem of smokers on the balconies of apartment buildings, but that it should be addressed in other ways.
“It just came to our notice then. Whether it is to be emphasized and decided in this way, to provide some additional work, be it for the police or for the public order service, I don’t think it is a fundamental problem in cities and buildings. apartment. I would be in favor of an agreement.
Is it normal and logical here for a co-owner to put everyone in some kind of situation? It would be better if it was a universal solution for the home, there are all kinds of ways to do it. These questions can be adopted democratically by majority vote. Leaving it to the decision of the apartment owner who complained, I don’t know if that’s really the way to go. The path of dialogue would be more effective, “said M. Sinkevičius.
He added that in this case, one must also think about where smokers can smoke.
“The smoker must also be considered where he should smoke.
Banning smoking on the balcony will not automatically stop that person. So where will you do it? In your private apartment, somewhere on the stairs, at the entrances to the house? But then we will have other situations from the solution of a problem ”, said the president of LSA to Eltai.
In accordance with the adopted amendments, the manager of the common use objects of the apartment building, the association of multi-apartment houses or the municipal executive body will be responsible for the installation of informative posters on the prohibition of smoking on balconies, terraces and apartment building loggias.
The new provisions also decide to ban smoking at covered public transport stops (pavilions), playgrounds and places where catering is provided to serve customers outdoors (outdoor tables, gazebos, other outdoor facilities), to Except for smoking areas.
The amendments also prohibit smoking during outdoor sports competitions or other outdoor events, except in smoking areas.
The law stipulates that the owner of a building (apartment) or another natural person who uses the building (apartment) and smokes in it must ensure that tobacco smoke does not enter the premises of another owner’s building (apartment) and into the facilities of the same apartment.
