In other Žuvintas biosphere reserve areas and hunting in reserves is carried out in accordance with the procedure established by the laws and other legal acts that regulate hunting ”.
Following the amendment, the following provision appeared: “Reserved biosphere hunting is carried out in accordance with the legislation governing hunting. ‘
The Ministry ensures that the legal regulations have not changed after the wording change.
At first glance, you could agree with the Ministry, but the director of the Žuvintas Biosphere Reserve points out that after updating the regulations, there were no references to other legal acts that prohibited hunting in the Biosphere Reserve.
It should be noted that hunting and other activities were and are prohibited in the nature reserve, in this case only the biosphere reserve.
The prohibition has been removed from some laws and has not been transferred to others.
A. Pranaitis 15 minutes affirmed that the activities in the reserve are regulated not by one, but by several legal acts, the most important of which are the regulations of the Žuvintas Biosphere Reserve and the management plan.
“In the previous version of the regulation, reference was made to other legislation that regulates hunting. That legislation was a management plan that made it very clear that in important areas, it is practically the entire biosphere reserve, except the forests, where the hunting of birds is prohibited ”, he said.
According to the reserve owner, the situation was such that the provisions prohibiting hunting in the re-management plan were eliminated and not transposed into other legal acts.
“I don’t know, maybe it’s the matter of the ministry kitchen here, I don’t want to comment, but it was such logic that everything had to be in the Hunting Rules,” he said.
We will recall that the attempts of the Minister of the Environment to change the Hunting Rules have turned into a real scandal a little earlier: Minister K. Mažeika, who has changed them and received much criticism, including from the Presidency, promised that all his changes would be corrected and a new version will be discussed.
However, the reality is that the process has taken a long time: the ministry has been negotiating the hunting regulations for a long time, and it was finally registered in the legal system in August. It has yet to be adopted, and as long as this process continues, there is still a highly criticized version of the Hunting Rules.
The Ministry does not refer to current legislation, but to its draft
The ministry, which issued the denial on Thursday evening, said it disagreed with allegations that it had not taken into account proposals for better protection of birds in protected areas and noted that the draft Rules Hunting does not change bird hunting procedures in nature reserves, biosphere reserves or other complex protected areas.
The Ministry explains that according to the draft Hunting Rules, in cases where nature reserves do not have designated buffer protection zones (this is the case of the Fishing Reserve), the following restrictions apply:
- playing injured is allowed only up to the limit of the state nature reserve. During the implementation of the approved measures for the control of contagious animal diseases, it is allowed to locate an injured wild boar that has entered the territory of a state natural reserve by notifying the corresponding protected area by telephone before entering the territory of the state natural reserve and have an animal search representative;
- It is forbidden to install feeders for ungulates, otherwise they are domesticated and attracted.
What do these restrictions have to do with hunting birds?
“The ministry proposes to read the draft hunting rules, not the current rules. There may be 27 projects, and in what it offers to read is not written a word that it is forbidden to hunt waterfowl there,” said A. Pranaitis.
The interlocutor considered whether the ministry intends to amend the legislation at all. Because even the draft Hunting Regulations mentioned by the Ministry does not mention the special requirements of Natura 2000 anywhere.
“The Natura 2000 requirements for the protection of migratory birds state that if the area is designated for migratory geese, the hunting of waterfowl must be prohibited. The same goes for winches, many species. That area is the entire biosphere reserve ”, He explained.
Therefore, according to the director, there is no prohibition in the draft Hunting Regulations, and it is removed from other legal acts.
“This means that hunting in the territory of the biosphere reserve is regulated in the usual way, there are no special or other requirements. It is true that hunting regulations establish that it is not possible to build towers on a tree in biosphere reserves, but this has absolutely nothing to do with hunting waterfowl ”, he emphasized.
A. Pranaitis emphasized that the reality now is that the hunting season for some species is already three weeks old, for other species it will start soon. “So now is the time to talk about the problem,” she stressed.
