Today she is one of the most important witnesses in a criminal case in which Bielinis, 60, who was convicted of sexual exploitation of a minor just a year ago, is again accused not only of sexual abuse of a minor, but also of drinking alcohol and minor health problems.

The victim, who was now 16 years old, was identified as a victim in the case by prosecutors, who were only 15 years old at the time of the alleged sexual abuse.

It was this young woman who was informed not only by social workers but also by educators about the danger this young man was in, but no one believed her and even warned that accusing another person without proof could cause him discomfort.

“It was already clear to me then that nothing good could be expected – no grown man would invite children into his home,” the woman summoned to testify with her son went to the Vilnius Regional District Court. – Many times I asked to leave my son, but he kept calling and calling. Imagine, he wanted to meet me, he talked on the phone about various nonsense, he said that the saints are not sitting in church either. “

The teenagers couldn’t resist

A woman who lived more than a hundred kilometers from Vilnius saw G. Bielinis in the courtroom for the first time, although she had spoken to him on the phone many times: her son and a young man who lived in the neighborhood were repeatedly tempted to go to the farm near Vilnius.

“They were promised they could make money in the summer,” he said. How much, the man did not say, but he assured that with the money young people will be able to make their dreams come true.

According to her, G. Bielinis was in the sight of socially vulnerable or even disabled adolescents: the mother of a young man recognized as a victim lived in a pension for the disabled and the father sat in a wheelchair and relieved pain with alcohol.

“He died after the incident and the victim was placed in an orphanage,” admitted the witness.

The Vilnius Regional Prosecutor’s Office, which carried out a pre-trial investigation, established that G. Bielinis had invited two young men to his home at the end of March last year. Another guy came with them; he knew G. Bielinis well, because he worked on various construction and repair jobs together. Both the fifteen-year-old man, who was recognized as a victim, and the eighteen-year-old disabled man who accompanied him had to work in construction.

“GRAMO. Bielinis invited them to come and meet, they wanted to talk and could not resist such offer; I tried to warn them, but the children did not believe, they did not imagine that they could be harmed, said the witness. – But when he returned from Vilnius the next day , I immediately realized that something had happened – the son then told me that the man had taken them to the sauna, gave them a drink and then they all went to bed together – he put my son and another boy in it room, and the fifteen-year-old was taken to another room. He did not want to go to sleep there, but Mr. Bielinis did not allow it. And at night he began to be sexually harassed. “

The help of psychologists was needed

Only G. Bielinis and the victim know what was happening in the room; He told officials that he had tried to resist, including a suitable man for his grandparents. The man who was indicted at the time did not admit guilt.

The young man, who has been recognized as a victim, has filed a lawsuit for non-pecuniary damage in a criminal case – asking for a fine of 20 thousand euros. Due to the possible abuse, the young man was treated by psychologists.

The prosecution determined that G. Bielinis had allegedly sexually abused a minor while another criminal case was pending in court. He found it in 2017. In June, G. Bielinis invited minors living in orphanages to his home, who overheard him drinking alcohol and gave teens money to communicate.

The man had a sexual desire for underage children; he once asked foster children to take him home. When other teenagers drank alcohol at home, the man lured this child into the room on the second floor of the house. And here, as the victim said, her hand grabbed him by the neck, threw him against the bed and squeezed his neck, breaking his resistance, trying to orally satisfy him by removing his pants.

The minor was rescued by his companions, who went in search of a friend in need: the bedroom door was locked, so they had to enter through it.

Boy for money

According to the minors, G. Bielinis, who invited them to his home and served them alcoholic beverages, also tried to harass other teenagers, one admitted that the man had tried to kiss him. And the sexually abused minor said that although he had met Bielinis with his friends after the incident, he was no longer consuming alcohol at the same time and was afraid of staying with him.

“He sought to have sex for money,” said another foster child.

At the time, Mr. Bielinis, while admitting that he had interacted with minors, claimed that the adolescents had led a provocation against him.

This defensive version of this was refuted by the court that heard the criminal case, noting that sufficient evidence had been gathered in the case that it was the convicted person who was the instigator of the sexual relationship.

“He could have renounced his illegal behavior, but he did not do so because he had been looking for a child before,” the court stressed. “The convict’s position shows that he does not assess the real danger of his actions for particularly vulnerable minors.”

The court also recognized that the minors also had the objective of intoxicating alcohol and having money, but these circumstances in no way justify the treatment that Mr. Bielinis gives to vulnerable young people.

G. Bielinis, who did not plead guilty to having sexual intercourse as a minor in a child-care home, received a court order: Judges of the Vilnius District Court of the Vilnius Regional District Court sentenced the convict to a year and a half in prison, which was suspended for three years. However, such a lenient sentence outraged the prosecutors who supported the prosecution and a sexually abused minor, who appealed the court’s sentence that had put him in prison.

After examining his complaint, the three-judge panel of the Vilnius Regional Court concluded that G. Bielinis had been unjustifiably released: he was sentenced to a real prison term of 3 years and 6 months.

Imprisoned for seeking to protect society

In convicting Mr. Bielini, the court not only took into account the fact that he had been previously convicted, formally admitted his guilt and regretted it, but at the same time noted that there were no extenuating circumstances, as the accused categorically denied his culpability.

“When deciding the amount of the sentence, the panel of judges also evaluated the nature of the act committed against the victim, which in the situation in question was not such either that important and severe custodial sentences are usually imposed,” the panel said of three judges. – In this case, violence against the victim was used to break his resistance, but this did not result in significant physical injury. Furthermore, the convicted person satisfied his sexual passion by performing oral actions against the victim himself, and not the other way around, the actions did not last long, which also shows the least danger of these actions ”.

G. Bielinis is serving his sentence at the Pravieniškės Correctional Center. He is also obliged to pay the victim 5,000. compensation for moral damage.

According to the judges, only a real custodial sentence can guarantee that “a climate of impunity does not form and the interests of the victims are not ignored, thus creating the legal conditions to ensure not only special but also general prevention.”

“The objectives of punishment and especially the objective of protecting society, in this case one of its most vulnerable groups, young children growing up in nursing homes, from criminal activity can only be achieved after G. Bielinis has been sentenced to a real custodial sentence, “said Judge Ernestas Rimšelis. .
