Judge will not publish full investigation report on Smollett’s state attorney’s treatment


Judge Michael Toomin announced Friday that he will not publish the full investigation report of the special prosecutor over 60 pages on how state attorney Kim Foxx handled the Jussie Smollett case.

The hearing took place in the Cook County Juvenile Building in Chicago.

Last week, Special Prosecutor Dan Webb, who received the probe, ruled the office abused his insight into the case against the actor, but did nothing criminal.

Webb told Judge Toomin that he needed permission to release the full report because it contained confidential material from the grand jury. Webb said the public should see the evidence he discovers to ‘restore public confidence’ in criminal law.

Ruben Castillo, a former federal judge now representing Foxx, ruled that the state’s law firm could be allowed to review the material privately and comment before it was presented to the public.

Castillo requested five business days to review the special report. “We do not want to put this off in any way,” he said.

In a statement on the conclusions of his investigation, Webb criticized the handling of the Smollett case by Cook County State Attorney Kim Foxx and her assistant prosecutors, saying her handling was marked by disarray and misleading statements.

In March of last year, Foxx’s office surprised and angered many in Chicago by letting accusations accuse the former “Empire” star of a racist and homophobic attack against himself. Smollett is still adamant that the attack was real and not a publicity stunt.
