Woman sued for Japanese Akita dog attack solves case

A mother of three who claimed to have been brutally attacked by her late father’s dog just days after his funeral settled her lawsuit in Superior Court.

The attack on Olivia Donnelly by the Japanese Akita dog, named Bran, the Superior Court heard, lasted 90 minutes and only ended when she managed to squeeze through a door and was dragged to safety.

Olivia Donnelly’s attorney, Aaron Shearer BL, told the court today that the case had been resolved and could be dismissed.

Judge Bernard Barton said he was very pleased to hear that the action had been compromised and said it was clearly a difficult case. The judge also noted that the loss of earnings claim had been withdrawn.

At the opening of the case this week, Ms Donnelly’s lead attorney, Hugh McGahon, said she was so savagely attacked that she was immediately transferred to Beaumont Hospital, Dublin, where she spent 11 days in intensive care and a total of eight weeks. at the hospital.

The key issue in Ms. Donnelly’s lawsuit for damages in Superior Court was who owned the dog at the time of the attack.

His attorney said that the other party alleged that Ms. Donnelly, as one of the persons entitled to inherit the property from her late father, may have owned the dog and therefore may be liable for her actions.

The lawyer said the early morning attack five years ago took place in the courtyard of the Redpenny Inn facility on Ardee Road, Co Louth and had been owned by Ms Donnelly’s tavern-keeper father, Michael, at the time of his death on November 4, 2015.

The lawyer said Donnelly owned the three-year-old Japanese Akita and never let anyone else get near the dog. The dog, he said, had a history of biting and biting and was a “savage attacker” of other dogs when he left the property.

Eight days after Mr. Donnelly’s funeral, the dog attacked Olivia Donnelly as she was going to bottle feed two other puppies from another dog on the property. The attorney said other family members “heard the commotion” and attempted to distract the dog and dragged Ms Donnelly through the pub door after she managed to get there.

The attack, McGahon said, lasted an hour and a half and Ms. Donnelly was left without the use of her left arm and had to undergo numerous operations. “It has no end,” said the lawyer.

The claims were denied and it was held that Ms Donnel allegedly did not take any or no proper care when she attended a location where she knew a Japanese Akita dog was present.
