The mother allegedly kicked the girl and lifted her by the hair, the Cork court said

A 20-month-old girl was kicked in the back and lifted off the ground by her mother who was drinking a bottle of wine in a suburban Cork city park.

These were the accusations in a case that was presented today before the Cork District Court where it was stated that the public was so concerned that the girl was taken from her mother until the gardaí arrived at the scene.

Garda Niall Comerford arrested the 40-year-old woman by appointment this morning for the purpose of indictment and brought her before the Cork District Court.

The main charge is that of child cruelty or neglect, which establishes that “as a person who cared for a child, you attacked the child in a way that is likely to cause unnecessary suffering or harm to the child’s health or that seriously affects your well being. “This charge can be handled at the district or circuit court level.

The second charge is being drunk in the charge of a child under the age of seven, a charge that can only be dealt with at the district court level.

Sgt. Pat Lyons said the director of the Public Ministry had ordered that both charges be dealt with summarily in Cork District Court.

Case outline

Next, it was up to Judge Olann Kelleher to hear a summary of the alleged facts in the case to decide whether to accept jurisdiction over the cruelty charge.

Garda Comerford said it is alleged that the defendant went to a suburban supermarket where she bought a bottle of wine at 6 p.m. on July 18. Then he went to the local park and consumed the bottle of wine.

“Several independent witnesses were concerned about the 20-month-old boy.

Witnesses observed that he was kicked in the lower back on several occasions. It is alleged that he lifted the boy off the ground by the hair.

“The girl was in a visibly distressed state and members of the public took the girl from her.

“The Gardaí came and found the mother sitting on a park bench,” said Sgt Lyons.

Judge Kelleher accepted jurisdiction.

‘The boy is in very good shape’

Frank Buttimer’s attorney requested a summary of the case from the prosecution and any child welfare reports that might be available.

“I anticipate a certain course here and would ask for a short postponement. I understand that there is no objection to the bond. She is here by arrangement. I think the boy is in very good shape and in very good shape at the moment, ”Buttimer said.

The case was postponed until January 29.

The child cannot be identified under the provisions of the Children’s Act, so, in effect, neither party can be identified.
