Detective Superintendent Dave Gallagher told the Special Criminal Court on Monday that he was satisfied that the criminal organization that attacked Hutch was the Kinahan gang.
Det Gallagher said the criminal gang has a hierarchical structure with subcells where specific roles were assigned to people. He agreed with the defense attorney that Mr. Capper was a “foot soldier” and was in financial trouble.
Audio surveillance of a vehicle recorded Mr. Capper asking Michael Burns, who also pleaded guilty to the same crime, for a loan of € 50, which was denied. Mr. Capper was heard to tell Mr. Burns that he would not be sitting in the back of the car if he had money.
Detective Gallagher told the court on Monday that this sheds light on Capper’s financial motivation as he struggled to get € 50.
The defense attorney told the court that Mr. Capper poured cold water on the plan and withdrew from the plan to conspire to assassinate Mr. Hutch.
Detective Gallagher said Capper was not the subject of the investigation the day before the attempted murder of Mr. Hutch, as he was dissatisfied with the plan and the others involved.

Mr. Capper will be sentenced on June 9.
