A well-known retired Cork businessman and former Scout leader has been arrested and charged with 26 historic counts of sexual assault on Boy Scouts.

David Barry of Firgrove Gardens, Bishopstown, Cork, was arrested by Garda Detective Gary Duggan and brought before the Cork District Court in custody.

“I am so sorry for anyone I hurt,” David Barry responded.

Det. Garda Duggan stated that he arrested David Barry at 7:40 a.m. at his home and took him to the Togher garda station at 8:10 a.m., where he charged him with 27 different charges regarding nine different whistleblowers: former boy scouts .

Many of them are now 40 years old.

Multiple loads

Seven counts are of sexual assault, 19 of indecent assault (which is the identical count as sexual assault) and one of attempted sexual assault. The attempted sexual assault is related to a whistleblower. The other charges refer in various ways to the other eight complainants.

When asked if he wanted to answer the charges, the defendant David Barry first told the detective that he did not want to answer the charges. He then added, “I am so sorry for anyone I hurt.” The charges relate to a period from 1986 to 2005 at a location in Cork. Many of the charges relate to the 1980s and 1990s.

Det. Garda Duggan said there were no objections to the defendant being placed on bail.

Bail conditions

The only bail conditions required by the state were that you surrender your passport and sign once a week at the Togher Garda station.

Sergeant Gearóid Davis said that the director of the Public Ministry had already given instructions on the case. The DPP conducted the trial by indictment by a judge and jury at the Cork Circuit Criminal Court. The DPP also consented to the defendant signing a plea at the district court level for sentencing in circuit court, should it arise.

Defense attorney Daithí Ó Donnabháin said an evidence book would be required.

At the request of Sergeant Davis, Judge Olann Kelleher postponed the case until January 27 in Cork District Court.
