Shlomo Mostofsky could not immediately be reached for comment Thursday.
But his brother, Nachman Mostofsky, told the outlet: “My brother did not do anything illegal … He was definitely not part of the riots.”
Like the vast majority of those who violated the capitol, Mostofsky was allowed to leave without arrest.
Another who smiled and asked for a photo looting Nancy Pelosi’s lectern was identified as Adam Johnson, a 36-year-old psychology graduate turned furniture manufacturer from Bradenton, Florida.
He is a stay-at-home father with five children; his wife is a doctor, according to The Bradenton Herald. He had previously faced possession of marijuana and violation of probation charges, the newspaper reports.
Photos from his now-deleted social media accounts show him posing next to a “closed to all tours” sign inside the building.
Johnson is also not believed to have been arrested in connection with the riots.
