A Dublin-based fuel retailer was hit with a € 9.1 million tax lawsuit from Revenue Commissioners, but none of the money will likely ever be paid.
The latest list of tax defaulters shows that a total of just under € 20 million in settlements in 17 cases are due in the third quarter of the year.
The demand of 9.1 million euros from DMG Energy was the highest of the period. The company was put into liquidation in 2013, having been incorporated in 2010.
The directors of DMG Energy are Damien and Francis McGleenan of Keady in Co Armagh, based in Northern Ireland.
The company was affected by a demand for taxes of 3.4 million euros, 2.5 million euros in interest and 3.1 million euros in fines. It occurred after an Income investigation for the non-declaration of excise taxes and an under-declaration of VAT. As of the end of September, none of the money owed to the Commissioners of Revenue had been paid.
The most recent account statement from the liquidator of the company shows that a total of only € 45,704 in assets has been realized in the company since it was liquidated.
The latest list of defaulters shows that Northern Irish businessman and publican Danny Fitzpatrick was among the most important cases of the period. From Ashton Heights in Newry, Co Down, Fiztpatrick received a 1.9 million euro lawsuit for underreporting of income tax after an income audit. It included 1.1 million euros of taxes, 441,000 euros of interest and 344,000 euros of penalties. Almost none if it had been paid at the end of September.
Mr. Fitzpatrick is a director of two companies in Ireland: Sherwood Investments and Ravensdale Investments. His family owned Fitzpatrick’s Bar and Restaurant on Rockmarshall in Dundalk, which was visited in 2016 by US President-elect Joe Biden when he was vice president.
However, it was temporarily closed in 2018 with a receiver appointed to Sherwood by the Bank of Ireland. It reopened shortly after being sold for € 2 million to a company linked to a Northern Irish beverage company. The receiver stopped participating in Sherwood in 2019.
Sherwood Investments received a claim for 10.9 million euros of Income in 2019 following an investigation. It was due to the under-declaration of PAYE, PRSI, USC and Vat.
Others on the latest list of delinquents released by the Commissioners of Revenue include Michael Feeley of Antogher Road in Roscommon.
Director of a company and farmer, received a lawsuit for 2.4 million euros after an income audit case for the non-declaration of capital gains tax. The settlement included 2.4 million euros in taxes, 720,000 euros in interest and 1.8 million euros in fines.
Shabra Plastics and Packaging at Castleblaney in Co Monaghan was hit by a nearly € 1.8 million settlement.
