A man in his twenties has been charged in connection with an incident in which an intruder wielding an ax broke his way into a house and forced a mother and son to take refuge in an upstairs room.

Michael Martin (21) from Mount Brosna, Mayfield, Cork appeared before a special session of the Cork District Court on Sunday evening.

He was charged with aggravated burglary of a home in Meadow Park in Ballyvolane on the north side of Cork City on October 24.

Judge Mary Dorgan heard evidence of arrest, indictment and warning from Det Garda John Gleeson of Watercourse Road Garda Station.

He told the court that Mr. Martin did not respond to the charge when it was presented to him after a warning.

He objected to bail for the defendant amid concerns that he would not be tried if bail was granted.

He also expressed the belief that Martin would commit more crimes if he was released. In addition, he alleged that Gardaí caught Martin red-handed.

Det Garda Gleeson said Gardaí responded to a call from a woman in her fifties who resides with her adult son in a home in Ballyvolane shortly before 2 a.m. on October 24. He said a man had broken into his house.

Gardai rushed to the scene. When they reached the house they found the side door open. They later discovered that the back door of the house had been broken open.

Det Garda Gleeson said that Gardaí entered the property where they allegedly found Mr. Martin armed with an ax rummaging through kitchen cabinets. He claimed that Martin dropped the ax and tried to escape through the front of the house.

Furthermore, he alleged that Gardaí caught Mr. Martin in the living room of the house and recovered the ax.

Det Garda Gleeson claimed that the woman and her son had taken refuge in an upstairs bedroom. They locked themselves in, but had to try to keep the door closed after Mr. Martin tried to force his way into the room. They also allegedly warned him that they had called gardaí in the hope that he would make him leave the property.

Det Garda Gleeson said Martin admitted to the Gardaí that he had taken cocaine on the night in question.

It also claimed that Mr. Martin attempted to flee garda custody while smoking a cigarette outside the Mayfield Garda station.

Defense attorney Frank Buttimer said his client was seeking bail. He said Martin had not been charged with a flight crime. He insisted that Mr. Martin appear for his court appearances.

Inspector Martin Canny said Gardaí was strongly opposed to Mr. Martin being released on bail given the seriousness of the charge, the weight of the evidence against him, and the fear that he would commit more crimes if he was granted bail. .

Judge Mary Dorgan rejected bail in the case, citing the seriousness of the charge. He considered an aggravation that mother and son were forced to take refuge in a closed room.

He placed Mr Martin in pre-trial detention to appear again in Cork District Court on 28 October.
