The German pedophile suspected of abducting Madeleine McCann may never appear in court for the crime.
The warning comes as investigators say they could be just one witness away from obtaining justice for Madeleine.
The prosecutor leading the investigation into Christian Brueckner’s alleged links to the child’s disappearance in Portugal in 2007, Hans Christian Wolters, said there was “no forensic evidence” and that other leads they had “were not sufficient to obtain a warrant for arrest”.
Pedophile Brueckner was identified as a suspect in June amid “strong evidence” claims.
But Wolters, who is leading the investigation in Germany, now says that without new leads, he will never be questioned about Maddie’s disappearance.
Wolters said he was “hopeful” that evidence would be found for police to charge and question Brueckner, 43, but added: “At the moment, our evidence is not so strong that we are confident the court will sentence him.” .
It is a turn of the prosecutor who has previously claimed that the police have “concrete” evidence that Madeleine is dead.
Now he told the They’ve Taken Her podcast, “Maybe we need more witnesses or photos or videos.”
He added: “We may need a witness who can tell us the things we don’t know.”
A friend of the McCann family said: “It feels like I’m trying to lower expectations after going out with all the guns on.
“It’s heartbreaking for Kate and Gerry.”
Brueckner, a homeless man with child pornography and rape convictions, is serving a jail term for drugs in Germany.
He lived near the Praia da Luz complex, where the three-year-old boy was kidnapped in 2007.
Brueckner’s attorney, Friedrich Fuelscher, says his client is innocent.
Detectives are reportedly searching for two Russian men they believe spoke to Brueckner before Maddie, then three, disappeared in Portugal in 2007.
Brueckner, who denies any involvement, is in a German jail for drug-related offenses.
He is also accused of raping a 72-year-old woman in Portugal in 2005.
