A 28-year-old man was denied bail after he was charged with dangerous driving and causing the death of a motorist in a head-on collision in Dublin.
Ardai and emergency services attended the scene of a fatal accident between a Volkswagen Passat and a Toyota Yaris on the N7 exit highway in Kingswood, Co. Dublin at approximately 12:20 am on September 21.
Anatolie Butucel, a Moldovan in his forties, driver of the Yaris, was pronounced dead at the scene. Two passengers in each vehicle were also seriously injured.
Thomas Doran, residing at Clonskeagh Road, Ranelagh, Dublin 6, was transferred from the hospital to Clondalkin Garda station on Friday evening.
He was seen by a doctor at the station and later charged with dangerous driving which caused the death of Mr. Butucel.
He was detained overnight pending his appearance before Judge John Hughes in Dublin District Court on Saturday.
The defendant, who was brought to court in a wheelchair, also had a broken arm. He has not yet indicated how he will plead.
Garda Kevin Coller told Judge Hughes that the defendant did not respond when he was charged.
Defense attorney Michelle Finan told the court that her client was requesting bail.
However, there was an objection from the Garda due to the seriousness of the case.
During the contested bail hearing, Garda Coller said the defendant was alleged to be the driver of the Passat that did not stop for gardai just after midnight on September 21.
The car was alleged to be traveling down Naas Road and traveling on the wrong side against traffic.
Judge Hughes was told that the Passat entered an exit lane of the N7 and collided with the Yaris driven by Butucel, who was pronounced dead at the scene.
Two passengers in each car suffered “life-changing injuries” and remain in intensive care, Garda Coller said.
He told the court that a witness did not believe that anyone would survive the collision, described as “like an explosion.”
Garda Coller said more serious charges are under consideration.
Pleading for bail, Doran’s attorney said he would honor the conditions of the bail. His father had recently passed away and his family was aware of the seriousness of the alleged crime, he said.
Mr. Doran’s mother watched the proceedings from the public gallery.
The lawyer said that the family did not have the means, but that they could get a substantial payment of up to 5,000 euros, however it would take time to get the money.
He would surrender his passport and obey the curfew, Finan said. He also alleged that his client is presumed innocent and is presumed to be released on bail.
Mr. Doran did not address the court and spoke only to instruct his attorney.
In declining bail, Judge Hughes said he noted the seriousness of the case and was convinced that the defendant was a flight risk.
Legal aid was granted to Mr. Doran, who is unemployed, but the judge told him that he should submit a media statement later. Ms Finan said that she was currently unable to fill one due to her broken arm.
Doran was placed in pretrial detention to appear via video link in Cloverhill District Court on Tuesday.
Noting his injuries, the judge also ordered that Mr. Doran should receive medical care in custody.
