Woman injured after slipping on ice awarded € 125,000

A woman who slipped on the ice and hit her head suffering a brain injury received 125,000 euros from the High Court.

Anna Maria Power, a 55-year-old taxi driver, Judge Kevin Cross said she suffered a serious injury. It accepted the medical reports in the case indicating that the woman suffered a moderate traumatic brain injury as a result of the fall.

Mrs. Power, the judge said, in no way exaggerated her injury and Judge Cross said she actually downplayed her situation.

Anna Maria Power, Devenish Road, Crumlin, Dublin had sued Walkinstown Auto Services Ltd, which is the qualified occupant of a location on Drimnagh Road Dublin, where Buzz’s Car Wash is located and Alan Lyons, Goatstown Road, Dublin, the owner of Buzz’s Car Wash, about the accident there on February 2, 2015.

It was claimed that visitors to its facilities could not be warned of ice on the esplanade.

Furthermore, it was claimed that the ice was allowed to accumulate and that precautions derived from weather conditions were not taken and the ice was not treated with sand or rock salt.

Ms. Power’s attorney, Kevin Callan BL, instructed by Alan Crossan’s attorney, told the court that no defense was presented in the case and that a default judgment was awarded. As a result, the case was submitted to the courts solely for the assessment of damages.

Ms. Power told the court that she had left her taxi for a wash and a valet and was walking on the esplanade when she slipped on the ice and fell on her back. He said he had terrible pain in the back of his head and at the base of his spine.

He said he later had a seizure and two others in the hospital. Scans at the hospital confirmed bleeding in the brain area.

Ms. Power was unable to work as a taxi driver for a year later and said her short-term memory is still very bad.
