Sean’s Bar in Athlone is among four establishments requesting payments for Covid-related losses.

The High Court is being asked to resolve a dispute between four bars and their insurer in what will have a huge knock-on effect for more than a thousand others.

Sean’s Bar in Athlone, and three Dublin pubs – The Leopardstown Inn, Lemon & Duke and Sinnotts – claim that FBD Insurance should compensate them for Covid-related losses.

The four pubs are seeking compensation for what they say are “consequential and continuing losses” arising from the tax closure of their businesses.

Another 1,100 publicans have policies identical to those at stake in these test cases, so they will be following this audience closely.

Michael Cush, who represents Dublin pubs, said the outcome for affected pubs could be the difference between being able to stay in business or not.

The fundamental question to be resolved is whether they are in fact covered. FBD claims they are not because it is a national pandemic and not a local outbreak.

If the court disagrees, you need to consider what the scope of coverage really is and find a way to calculate losses.

The hearing must take up to twenty days.
