Gardaí Opposes Achill Pub License Renewal Due to Covid-19 Breaches

Gardaí has ​​opposed the renewal of a license for a pub on Achill Island in Co Mayo for alleged breaches of Covid-19 regulations in one of the first such cases.

Opposing the renovation of the Ted Lavelle Public House in Cashel, Achill before the Achill District Court, Inspector Dennis Harrington alleged that there are “ongoing violations” of Covid-19 rules occurring.

Two cases have already been sent to the Director of the Public Ministry for consideration. The DPP has ordered the prosecution of one and a decision on the second is pending.

Insp Harrington, who said the local Gardaí could have issued further prosecutions against the licensee, Joseph Fadian, said the state “does not take lightly a request to take a man’s livelihood.” Gardaí wanted local compliance with Covid regulations and all other Achill-licensed facilities had been inspected the same number of times “without a problem,” the official said.

However, Fadian has “systematically ignored” the advice of the four local Gardaí. The objection was “a last resort,” Insp Harrington told Judge Fiona Lydon.

He asked for a postponement until November. Meanwhile, gardaí will control the conduct of the pub. So they “can” take a different attitude if they see a shift in focus from Mr. Fadian.

Defense attorney Rory O’Connor said the innkeeper had not been given the mandatory 21-day notice and that the gardaí’s request was flawed as a result.

The innkeeper is complacent and has a “difference of opinion” with Gardaí, he said. He asked Gardaí to come to the premises with him and his client to discuss what infractions are taking place.

He said the precise regulations are evolving regularly. Even the ministers are not entirely clear on them and he asked how the publicans could be fully aware of them as a consequence.

The lawyer also asked if there was any publication that established the regulation. He said he did not want to do so, but could write to the inspector asking him to specify what rules were being violated.

Clear regulations

However, Insp Harrington said some regulations were clear from the start, including rules that patrons cannot sit at bar counters and that drinks must be brought to tables and patrons must eat.

“The State will argue that it openly fails to comply [regulations] . . . We have given the advice, it is not rocket science. The regulations are very clear ”, he declared.

“They can’t help you at the counter, you must be seated and you can’t stay there for more than one hour and 45 minutes. He does not comply regularly, that is our accusation. Continue to ignore the advice given, ”said Insp Harrington. Mr. Fadian had an obligation to comply with the Health Act of 1947 as amended, he said.

Insp Harrington said that each of the four Gardaí in Achill had already given that advice to Mr. Fadian.

He said that if Mr. Fadian “changes his way” in two months, the matter “may not bother the court.”

The judge said the state had been “more than reasonable.” She advised Mr. O’Connor to have a discussion with her client, deferred the matter until November 12, and directed Mr. Fadian to obey existing and new regulations.
