Four-year-old Kerry ‘raped by babysitter’s 14’ son, court hears

A four-year-old Kerry boy was raped by his babysitter’s 14-year-old son while playing “a magic game” in the teenager’s bedroom, it was alleged at the opening of a trial today.

The defendant, who is now 16 years old, was tried before Judge Eileen Creedon and a jury of six men and six women at Cork Central Criminal Court.

The teenager denies the only charge of orally raping the four-year-old girl on December 14, 2018.

It is alleged that the author closed his eyes in the defendant’s bedroom for “a magic game” when the defendant then put his penis in the boy’s mouth. Judge Seán Gillane SC told the jury that this type of sexual assault is also known as rape.

Mr. Gillane said that the jury would have to address the youth of the parties in this particular case.

The first part of the complainant’s evidence presented to the jury consisted of a pre-recorded interview conducted by specialized garda interviewers who deal with minor complainants in sexual cases.

In the recorded interview, the boy said: “He started putting me in my mouth and everything happened.”

When asked what he put in his mouth, the boy replied: “His will.” They later asked him how he felt and he replied, “That made me sad.” When asked to explain this further, the boy said, “You are sad and you are not laughing.” He said the babysitter’s son had Transformer toys on a high shelf in his bedroom and said that he and the complainant could play with them after playing “the magic game.”

Mr. Gillane SC said at the opening of the case that on the afternoon of the alleged rape, the boy and other children in his family were being cared for by a babysitter at their home when it was alleged that the babysitter’s son raped the boy.

Mr. Gillane said that later that night, the boy’s mother took her children, including the complainant, around her town to see the houses that were lit up for Christmas.

“On the way home [child’s name] He said something in the car that caused his alarm. He said [defendant’s name] put your willy on [another boy’s] mouth, ”said the chief attorney for the prosecution.

The mother said they would talk about it when they got home and called her husband to come back from work. The child was warned not to say anything that was not true and then said that the accused had put her will in her [the complainant’s] mouth in the defendant’s bedroom.

“[Child’s name] He said it happened during a magic game where he had his eyes closed, ”Gillane said.

Defense attorney Colman Cody questioned the boy who was present in another courtroom that was linked by video to the courtroom. A professionally qualified intermediary was present with the child and she intervened several times when the child needed a short break and in one case where she said a question was too complicated and should be broken down into smaller parts.

The trial continues on Tuesday.
