If Trump loses the election, there may be calls to investigate and prosecute him for possible crimes that involve obstruction of justice, violation of the emoluments clause of the constitution and / or tax fraud, among others. Citizen Trump would face an investigation without the luxury of “executive privilege” or the legal ruse of Attorney General William Barr, who has acted more like Trump’s personal attorney than the nation’s top law enforcement official, to protect him. Consequently, Trump has even more reason to lie, cheat and sow discord to keep the job, because losing the White House could land him in court or even behind bars.
Although special counsel Robert Mueller did not present irrefutable evidence to prove that Trump conspired with Russia in the 2016 election, he clearly stated that the investigation did not exonerate Trump of wrongdoing.. Following the investigation, more than 1,000 former federal prosecutors from both sides signed a letter declaring that Trump’s conduct, as described in the investigation, would justify “multiple felony charges for obstruction of justice” were it not per the policy of the Office of Legal Counsel not to impeach a sitting president.
The most recent criticism of Mueller from top advisers in the investigation alleges that Mueller did not go far enough in exposing the collusion between the Trump campaign and Russia. At the very least, there is a strong case that Trump obstructed the investigation. After he leaves office, there will be vocal calls to get to the bottom of Russian electoral interference, the alleged collusion of his campaign, and hold the former president responsible for obstruction of justice. The result could very well be a subpoena for the former president or even an indictment.
