Topline
Polish game developer CD Projekt is facing a class action lawsuit over the failed launch of Cyberpunk 2077, which has already tarnished the company’s reputation in what has become one of the most notable blackouts in video game history.
Key facts
The lawsuit was filed on behalf of the investors and alleges that CD Projekt made materially false statements by failing to disclose that Cyberpunk 2077 “was virtually unplayable on current generation Xbox or Playstation systems due to an enormous amount of bugs.”
The lawsuit refers to a series of positive statements made by executives about the game ahead of its launch, including an October earnings call in which joint CEO Adam Kiciński said: “I wouldn’t say there is a ‘problem’ because there is there is nothing wrong with Xbox or PS4 versions. “
The complaint alleges that the failure to disclose the problem gambling amounts to a violation of federal securities laws and seeks an unspecified amount of damages.
The New York-based Rosen Law Firm, which filed the lawsuit, is still seeking plaintiffs to join the case and notes in a press release that one class has not yet been certified.
CD Projekt did not immediately respond to a request for comment from Forbes.
Key Background
Cyberpunk 2077 had been in development for almost a decade and was expected to be the best video game of the year. But instead, the game is riddled with hilarious bugs and errors that sometimes make it difficult for a player to walk or talk. After many complaints, CD Projekt apologized, promised refunds, and promised to fix the game with future updates. Sony pulled the game entirely from the PlayStation Store. The debacle has cost the two Polish co-founders of CD Projekt a combined wealth of $ 1 billion after their shares fell 40% last week. Forbes reported.
