Eric Trump’s lawyers said Thursday they were ready to step down as part of an investigation into the Trump organization’s New York attorney general’s office fees, but only after the 2020 presidential election.

Prosecutors also denied that he had previously refused to comply with the subpoena for his testimony, as alleged by the Office of the Attorney General of New York, Letia James.

“While we cannot comment on specific steps in a specific lawsuit, we will not allow any entity or individual to proceed with our investigation or allow anyone to be legally excused,” James said in a statement to CNBC.

“No one is above the law, period,” James said.

AG’s office fees last month revealed in a civil investigation into Trump and his company how they valued many of Trump’s assets on the basis of annual financial statements used to obtain loans, as well as financial and tax benefits.

In a filing in August Gust’s court, the AG’s office fee said the Trump organization “completely refused to comply with the subpoena for Eric Trump’s testimony.”

“Eric Trump’s refusal to make a clear statement is illegal, and he should be forced to testify,” James wrote in his office fee.

But lawyers for Eric Trump, the Trump organization’s executive vice president, responded Thursday that he had “not indicated at any time that he is refusing to comply with the subpoena.”

“The lawyer first made a request for certain assurances,” said attorneys from the attorney general’s office.

Those terms include confirmation from the AG that it “does not provide, and will not provide any material, information or transcripts developed or collected during its investigation to any other law enforcement authority, agency or regulator.”

Regardless, Eric Trump’s advisers wrote, they have since made it clear that their client is willing to comply with the subpoena. Prosecutors said it is known that for the most part, law enforcement and regulatory agencies enthusiastically ignore certain measures within the 60-day period before a major election.

The earliest proposed date is 19 Nov.
