Supporting the construction of the pilot area of the free island of Hainan and the gradual exploration of Hainan and the constant progress of the construction of a free trade port with Chinese characteristics are important decisions made by the Central Party Committee and the State Council . To support the comprehensive deepening of the Hainan reform and opening and the implementation of the Hainan Pilot Free Trade Zone pilot policy, Yuan Shuhong introduced that the draft mainly includes three aspects:
One is to temporarily adjust and implement the relevant provisions of Article 35, Paragraph 1 and Article 46, Paragraph 1 of the Land Administration Law of the People’s Republic of China. The State Council authorized the approval of the Hainan Provincial People’s Government. With the premise of strictly implementing the policy of permanent basic protection of agricultural land, ensuring that the total amount of land cultivated in the Hainan Free Trade Zone does not decrease, quality does not decrease and construction land does not increase on the basis Existing, the Hainan Provincial People’s Government will formulate specific management measures to improve implementation. Post-event monitoring measures will be implemented with the consent of the State Council department in charge of natural resources.
The second is to adjust and temporarily implement the relevant provisions of Article 31, paragraph 1, of the Seed Law of the People’s Republic of China, and engage in seed import and export business in the Hainan Pilot Free Trade Zone. Forest departments and authorities are delegated to Hainan Provincial Agricultural and Rural Authorities and Forest Authorities. With the premise of strictly implementing the isolation and supervision of introduced germplasm resources, preventing biological invasion, and strengthening risk assessment and quarantine supervision, the Hainan Provincial People’s Government will formulate specific management measures and improve the implementation of post-event monitoring measures. 1. The third is to temporarily adjust and implement the relevant provisions of Article 4, Paragraph 2 of the Maritime Law of the People’s Republic of China, and establish market standards for cruise companies (operating entities) and cruises in the Pilot Zone of Hainan Free Trade to conduct China-funded flag of convenience cruise business. Permission to enter multipoint calling routes for foreign cruises that only involve ports in the Hainan Pilot Free Trade Zone is delegated from the transportation department of the State Council to the transportation department of Hainan Province. Based on the Hainan shipping area and the state of development of Hainan International Cruise Lines, before the Hongqi five-star cruise is put into operation, Chinese cruises can conduct the upstream business of convenience cruises with Chinese flavor at Sanya and Haikou Cruise Ports in Hainan. The Hainan Provincial People’s Government will formulate specific management measures, organize relevant departments and the Municipal People’s Governments of Sanya and Haikou to implement their oversight responsibilities in accordance with their responsibilities, and strengthen the oversight of pilot operators and cruise operations.
The draft makes it clear that the above adjustments will be implemented before December 31, 2024. In order to temporarily adjust and implement the relevant laws and regulations, it is necessary to establish and improve a post-event monitoring system to prevent and control risks in a timely manner. The Council of State and its relevant departments must strengthen the orientation, coordination and supervision, and summarize the experience of the pilot work in a timely manner. If the practice is feasible, the relevant laws will be reviewed and improved; if the practice is inappropriate for adjustment, the relevant legal provisions will resume.
